Contractor That Evaluated Greenhouse Gas Emissions for Keystone XL Report Had Ties to TransCanada

The contractor that evaluated greenhouse gas emissions for the State Department's Keystone XL report is the latest company to come under fire for its ties to TransCanada, the prospective builder of the controversial pipeline.
A conflict-of-interest statement from the consulting firm ICF International, submitted to the State Department in 2012, reveals that the company had done other work for TransCanada.

ICF International analyzed greenhouse gas emissions from tar sands oil, the kind that would flow through the pipeline, for the State Department's supplemental draft environmental impact statement, released in March 2013. Its website states that the firm was hired to compare life-cycle emissions associated with oil derived from Canada's tar sands to those associated with oil from conventional crude.
The final environmental impact statement (FEIS), released in January 2014, also includes ICF International on its list of preparers, with ICF staffers working on the greenhouse gas and market analysis portions of the report.
The FEIS concludes that the projected 830,000 barrels of oil that would flow through the pipeline every day would add between 147 million and 168 million metric tons of greenhouse gas emissions to the atmosphere annually. Confirmed: Fracking practices to blame for Ohio earthquakes

Wastewater from the controversial practice of fracking appears to be linked to all the earthquakes in a town in Ohio that had no known past quakes, research now reveals.

The practice of hydraulic fracturing, or fracking, involves injecting water, sand and other materials under high pressures into a well to fracture rock. This opens up fissures that help oil and natural gas flow out more freely. This process generates wastewater that is often pumped underground as well, in order to get rid of it.

A furious debate has erupted over the safety of the practice. Advocates claim fracking is a safe, economical source of clean energy, while critics argue that it can taint drinking water supplies, among other problems.

One of the most profitable areas for fracking lies over the geological formation known as the Marcellus Shale, which reaches deep underground from Ohio and West Virginia northeast into Pennsylvania and southern New York. The Marcellus Shale is rich in natural gas; geologists estimate it may contain up to 489 trillion cubic feet (13.8 trillion cubic meters) of natural gas, more than 440 times the amount New York State uses annually. Many of the rural communities living over the formation face economic challenges and want to attract money from the energy industry.

Parents and Educators Can Keep Young Workers Safe

As parents and educators, you play an important role. Here is vital information you need to know.
  • Employers must provide a safe and healthful workplace and comply with OSHA standards to prevent injuries and illnesses. Employers must train new workers on job hazards and safe work practices in a language they understand. Employers must also pay for most types of required safety gear.
  • Child labor laws restrict the types of jobs and the hours that youth under age 18 can work. They also prohibit workers under age 18 from using certain equipment. Learn about the federal and state child labor laws that apply to young workers.
  • States may develop and operate their own job safety and health programs with federal OSHA's approval and monitoring. There are currently 22 states and jurisdictions operating complete state plans (covering both the private sector and state and local government employees) and five plans that cover public employees only. Saving Money, Poisoning Workers

The workers at Royale Comfort Seating in Taylorsville, N.C., had a simple but grueling job. For 10 hours at a stretch they spray-glued pieces of polyurethane foam into shapes that became the spongy filling of cushions sold to many top furniture brands. Unfortunately, the glue contained a dangerous chemical known as n-propyl bromide, or nPB, and the spray guns left a yellowish fog in the air that coated everything in sight. Exposure to the toxic fumes left some workers so dizzy at the end of the day that they walked as if drunk.

Worse yet, many developed long-term ailments. One worker can no longer stand or sit for more than 20 minutes without feeling excruciating pain in her spine and legs. Another lost control of his hands and could not put on clothes without help.

EPA Expands List of Safer Chemical Ingredients

The U.S. Environmental Protection Agency's (EPA) today added more than 130 chemicals to its Safer Chemical Ingredients List. For the first time, 119 fragrance chemicals for commercial and consumer cleaning products have been added to the list.

“Fragrances are an important yet complex part of many consumer cleaning products. By adding fragrance and other chemicals to the Safer Chemical Ingredients List, EPA continues its commitment to help companies make safer products and provide the public with greater access to chemical information,” said James Jones, acting assistant administrator for the Office of Chemical Safety and Pollution Prevention.

The Safer Chemical Ingredients List, which now contains 602 chemicals, serves as a resource for manufacturers interested in making safer products; health and environmental advocates seeking to encourage the use of safer chemicals; and consumers seeking information on the ingredients in safer chemical products.

It also serves as a guide for Design for the Environment (DfE) labeled products, which must meet EPA’s rigorous, scientific standards for protecting human health and the environment.

Fashion Safety - Why Won't American Companies Get In Line?

US retailers are continuing to ignore the deadly working conditions in Bangladesh. Fashion Safety was the 1911 catalyst for bringing safer working conditions to Americans and established a legal basis for compensation for occupational injuries outside of the civil justice system.

While the European companies are now joining together, along with economic interests, to establish a program for safer Bangladeshi garment factories following the recent tragedies, major US retailers like Walmart, Target and the Gap are ignoring the effort.

"Labor and consumer groups have pressed Western retailers to join the plan, especially after the factory building collapse and after a fire last November killed 112 workers in a Bangladesh factory. The plan, which many labor unions and nongovernment organizations also have signed, is called the Accord on Fire and Building Safety in Bangladesh."

Safety Inspector Sought
Bangladesh Safety Accord Seeks Chief Safety Inspector. The Accord on Fire and Building Safety in Bangladesh garment factories is seeking a chief Safety Inspector to recruit, train, deploy and manage an inspectorate in Bangladesh to protect the safety and health of four million garment workers. The Accord has been signed by more than 50 clothing companies and the Global Unions IndustriALL and UNI. The Safety Inspector will be paid US$200,000 and divide his/her time between Dhaka, Bangladesh and an office in Europe. Accord on Fire and Building Safety in Bangladesh

Safety Inspector: Terms of Reference / Job Posting

Introduction

The Accord on Fire and Building Safety in Bangladesh (“Accord”) is an historic agreement between the Global Unions IndustriALL, and UNI, and numerous global Brands and Retailers, to improve safety standards in Bangladeshi textile and garment industries. The Accord is governed by a Steering Committee appointed by the signatories.

Terms of Reference

The Safety Inspector, reporting to the Steering Committee, will recruit, train, develop, deploy and supervise an inspectorate capable of evaluating fire and electrical safety, structural safety, and worker safety in Bangladeshi garment factories that supply the Brands. The successful candidate will divide his/her time between Dhaka, Bangladesh and an office to be established in Europe.

The Safety Inspector will coordinate a preliminary classification of factories based on existing and provided information, brief initial inspections where necessary, and take into consideration other recent audits performed by some of the Brands.

S/he will recommend to the Accord Steering Committee fire safety and building safety standards that will be applied by the Accord. Developing these recommendations is anticipated to be an ongoing process that may take a considerable amount of time. These must satisfy, but may go well beyond, existing Bangladeshi regulations and standards.

S/he will recommend to the Steering Committee a methodology for safety inspections and interventions, taking into consideration the successes and failures of previous similar initiatives. This methodology must be able to be set out as guidelines for the inspectorate to be trained on and to follow. Methodologies may be necessary for both quick screening inspections and more in-depth analyses.

The Safety Inspector and the inspectorate must as a group be capable of evaluating:

- structural hazards such as design and material deficiency, insufficient consideration of geological or environmental conditions, overloading, etc.

- fire hazards, including general housekeeping, storage of flammables, dust control, sources of ignition (cutting, welding, open flame, electrical installations, heating systems, boilers etc.), as well as inadequate emergency procedures and escape routes.

- workplace hazards resulting from unsafe materials (including dangerous chemicals), tools, electrical installations, equipment, poor ergonomic design, or a contaminated or overcrowded workplace environment.

- hazards resulting from work organization, such as lack of training, lack of effective workplace health and safety committees, lack of attention to workers' rights (such as the right to refuse unsafe work) and other management policies and practices that would put buildings and the people in them at risk.

The Safety Inspector and the inspectorate as a group will prioritize factories based on the degree of remediation required. Based on the inspection findings, s/he will recommend remedial action for building and fire safety, including worker and management training, fire detection, protection, and firefighting measures, as well as evacuation measures and the need for practice drills. These recommendations will be provided to factory owners, Brands contracting products from the factories and the Steering Committee.

The preceding points are not an exhaustive list. The Safety Inspector will work with the Steering Committee to establish a more complete job description.

Qualifications and Skills Desired

The ideal candidate will be able to apply extensive technical skills with leadership, diplomacy, and courage.

Qualifications

The ideal candidate will have knowledge of most of the safety disciplines described below, but it is understood that the successful person may not have expert-level knowledge in all these areas and should be free to consult other experts where required.

- Bachelor's degree or higher in a related discipline such as civil, structural, or fire engineering

- Thorough knowledge of the building and/or fire safety codes of a high-standard jurisdiction.

- Professional certification or licensing by a major national or international body

- Minimum 10 years of relevant experience

Skills

- The skills necessary to establish and lead a group and administer a budget approved by the Steering Committee are essential.

-  Evidence of social and cultural sensitivity; some knowledge of human and labour rights, are important assets.

Compensation

This is a high-level position. Depending on qualifications and experience, the salary for this position will be in the range of $200,000 USD with a generous benefits package.

Serious Safety Hazards Results in $49,600 in Fines for Paterson NJ Contractor

The U.S. Department of Labor's Occupational Safety and Health Administration has cited Paterson-based R.E. General Contractor LLC for alleged repeat and serious violations of occupational safety standards found while workers replaced a roof on a commercial building at 500 Grand St. in Paterson. The general contractor faces a total of $49,600 in proposed fines following a December 2012 imminent danger inspection by OSHA's Hasbrouck Heights Area Office.

Two repeat violations, with a $46,800 penalty, were cited for exposing workers to fall hazards of
approximately 50 feet while workers engaged in roofing work without fall protection in place. Workers also used an extension ladder that did not extend at least 3 feet above the upper landing surface. A repeat violation exists when an employer previously has been cited for the same or a similar violation of a standard, regulation, rule or order at any other facility in federal enforcement states within the last five years. OSHA cited similar violations in 2008, 2010 and 2011.

One serious violation, carrying a $2,800 fine, resulted from the failure to provide workers with hard hat protection while working near the forks of a material boom lift. A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

"OSHA will not tolerate this company's continuous disregard for adequate fall protection," said Lisa Levy, director of OSHA's Hasbrouck Heights Area Office. "Employers have a responsibility to ensure that workers exposed to fall hazards are provided with the proper fall protection equipment, are trained in its use and wear it whenever a fall hazard is present."

OSHA has created a Stop Falls Web page at http://www.osha.gov/stopfalls with detailed information in English and Spanish on fall protection standards. The page offers fact sheets, posters and videos that vividly illustrate various fall hazards and appropriate preventive measures.

R.E. General Contractor LLC has 15 business days from receipt of the citations to comply, request an informal conference with the OSHA area director in Hasbrouck Heights, or contest the citations and proposed penalties before the independent Occupational Safety and Health Review Commission.

Apple Is Moving Distracted Driving Into High Gear

Transportation accidents account for a high proportion of work-related fatalities, and Apple's announcement with week of increasing the access of iCar-Technology into the automobile is raising serious concerns among safety lobbyists.

Transportation (DOT) have made major efforts over the last few years to target distracted driving as a major safety issue to avoid serious accidents and ultimately save lives and reduce insurance costs. The DOT reports, "Distracted driving is a dangerous epidemic on America's roadways. In 2011 alone, over 3,000 people were killed in distracted driving crashes."

As of June 2013, 41 state, the District of Columbia, and Guam ban text messaging for all drivers. Also, 11 states, the District of Columbia, and the Virgin Islands, prohibit all drivers from using handheld phones while driving.

OSHA fines two companies $130,500 for trenching hazards at Kearny, NJ, site

Many workers' compensation accidents occur while working in trenches. The employer in NJ is insulated under the exclusivity doctrine from a claim for negligence. An employee's only remedy in many instances is only the NJ Workers' Compensation benefits.

VM Construction Inc., based in Miami, and Concrete Systems Inc., based in Sterling, were cited by the U.S. Department of Labor's Occupational Safety and Health Administration for willful and repeat trenching hazards found at a Kearny work site. OSHA's November 2012 investigation was prompted by an imminent danger complaint that alleged workers

operated in an unprotected excavation 8 feet deep.

One willful violation, carrying a $28,000 penalty, was cited against VM Construction Inc. for those workers operating in an unprotected excavation. A willful violation is one committed with intentional, knowing or voluntary disregard for the law's requirements, or with plain indifference to worker safety and health. The construction company was also cited for one serious violation, with a $2,400 penalty, for failing to ensure a competent person inspected the excavation prior to allowing workers to enter. A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

Concrete Systems Inc., a concrete and masonry contractor, faces $100,100 in penalties for two repeat violations involving workers operating in an unprotected excavation and entering an excavation that was not inspected beforehand by a competent person. A repeat violation is issued when an employer previously has been cited for the same or a similar violation of a standard, regulation, rule or order at any other facility in federal enforcement states within the last five years. Similar violations were cited in 2008.

Because of the nature of the hazards and the violations cited, Concrete Systems has been placed in OSHA's Severe Violator Enforcement Program, which mandates targeted follow-up inspections to ensure compliance with the law. OSHA's SVEP focuses on recalcitrant employers that endanger workers by committing willful, repeat or failure-to-abate violations. Under the program, OSHA may inspect any of the employer's facilities if it has reasonable grounds to believe there are similar violations.

"Improperly protected trenches can collapse suddenly and with great force," said Kris Hoffman, director of OSHA's Parsippany Area Office. "OSHA implemented a trenching and excavation special emphasis program in the 1980s, so the industry is well aware of the safety regulations for trenching operations."

Forecasters Predict Increased Hurricane Activity Raising Concern for Worker Saftey

On the heels of last year's Superstorm, Hurricane Sandy, some of the nation's top storm forecasters are now predicting yet another year of above average storms. The dire prediction raises concerns over the prospects on ensuring worker safety, and whether the workers' compensation system is capable of delivering benefits in an efficient and effective manner during recurrent natural disasters.


"We anticipate that the 2013 Atlantic basin hurricane season will have enhanced
activity compared with the 1981-2010 climatology. The tropical Atlantic has anomalously warmed over the past several months, and it appears that the chances of an El Niño event this summer and fall are unlikely. We anticipate an above-average probability for major hurricanes making landfall along the United States coastline and in the Caribbean. Coastal residents are reminded that it only takes one hurricane making landfall to make it an active season for them, and they need to prepare the same for every season, regardless of how much or how little activity is predicted."

Protecting Healthcare Workers

Kerri A. Thom, MD, MS, Assistant Professor of Medicine at the University of Maryland School of Medicine, puts a spotlight on the healthcare environment and its role in spreading bacteria that cause healthcare-associated infections. She discusses this topic in context of the Society for Healthcare Epidemiology of America(SHEA) spring meeting, where professionals in healthcare epidemiology and infection prevention are focusing on evidence-based research and policies to further identify the impact of the healthcare environment on healthcare-associated infections.

"At the meeting, several sessions examine motivation and behavior change techniques that
can optimize the efficacy of a good old-fashioned cleaning and disinfection. While hospital cleaning staff often focus on the disinfection of patient rooms’ bathrooms, other near-patient surfaces and equipment can be overlooked. SHEA believes educating staff on the role of the healthcare environment and optimizing worker performance can be one of the most effective measures to adequately disinfect patient rooms.

OSHA Moves to Protect Temporary Workers

OSHA launches initiative to protect temporary workers from injuries at work.

The U.S. Department of Labor's Occupational Safety and Health Administration today announced an initiative to further protect temporary employees from workplace hazards. The announcement was made during a program at the department's headquarters marking Workers' Memorial Day – an annual observance to honor workers who have died on the job and renew a commitment to making work sites across the country safer.

OSHA today sent a memorandum to the agency's regional administrators directing field inspectors to assess whether employers who use temporary workers are complying with their responsibilities under the Occupational Safety and Health Act. Inspectors will use a newly created code in their information system to denote when temporary workers are exposed to safety and health violations. Additionally, they will assess whether temporary workers received required training in a language and vocabulary they could understand. The memo, which can be viewed at http://s.dol.gov/ZM, underscores the duty of employers to protect all workers from hazards.

"On Workers' Memorial Day, we mourn the loss of the thousands of workers who die each year on the job from preventable hazards," said Dr. David Michaels, assistant secretary of labor for occupational safety and health. "Many of those killed and injured are temporary workers who often perform the most dangerous jobs have limited English proficiency and are not receiving the training and protective measures required. Workers must be safe, whether they've been on the job for one day or for 25 years."

NASA: Safety Is Prime for Today's Launch of Antares

NASA is preparing for the launch of Orbital's Antares™ A-ONE Test Flight Mission scheduled for today at 5pm. I was a guest of NASA this week and toured the facility including the launch pad. Safety is prime for NASA and its corporate affiliates like Orbital.

Launching a space mission is a complex and massive operation. The balancing of public and mission safety concerns is extremely important. Besides the ordinary employee safety issues such as: hearing and eye protection, radio transmission frequency triggers and fire, NASA must identify and protect the public.


Unlike some other nations, the US launches its rockets near the ocean, and strictly monitors their trajectory. Any deviation from the planned flight path, ie. jeopardizing public safety, would result in the the destruction of the rocket over an isolated over-water area.

Today's planned launch will be televised on NASA TV and cane be viewed from a large area on the US Mid-Atlantic seacoast.
