There Are 1,401 Uninspected High-Risk Oil and Gas Wells. Here's Where They Are.
In May, the Government Accountability Office estimated that an even larger share of new wells on federal land—57 percent—were not inspected. While the revised 40 percent figure, which was first reported by the Associated Press, is lower, it's "still not a very good number," acknowledged BLM spokesperson Bev Winston.
Between 2009 and 2012, the BLM tagged 3,486 new oil and gas wells as "high-priority," meaning they are deserving of special scrutiny because of their proximity to ecologically sensitive areas like watersheds and forests, or because they tap into geologically volatile formations that increase the likelihood of an explosion or toxic gas leak. The data includes both conventional and unconventional wells and does not indicate how many of the wells were hydraulically fractured, or fracked.
"We're scattered, and you can't be everywhere at once," a top BLM official said.
According to the GAO report, the agency's own rules call for all high-priority wells on federal and Native American land to be inspected during the drilling stage. That's the only time when key facets of a well's construction—whether the well casing is properly sealed, or whether a blowout preventer is correctly installed, for example—can be adequately inspected. Once the well is drilled, retroactive inspection becomes difficult or impossible, according to a BLM engineer.

Jury awards Texas family nearly $3 million in fracking case

In a landmark legal victory that centered on fracking, a middle-class north Texas ranching family won nearly $3 million from a big natural gas company whose drilling, they contend, caused years of sickness, killed pets and livestock, and forced them out of their home for months.
Tuesday's $2.95-million civil verdict by a six-person Dallas jury is thought to be the first of its kind in the nation. Other landowners have sued over drilling and reached settlements, but legal experts think this is the first jury verdict.
Robert and Lisa Parr filed suit against Aruba Petroleum Inc. in 2011, contending that its operations near their land had contaminated the air and harmed their health. Their lawsuit has been closely watched by both critics and supporters of hydraulic fracturing, or fracking, which involves pumping water laced with chemicals into shale formations to unlock trapped oil and gas.
"I am just overwhelmed," Lisa Parr said in a telephone interview Wednesday. "I feel like I am just this little bitty girl, this little family who just beat the biggest, most powerful industry in the world."
Aruba Petroleum, based in Plano, Texas, said it had done nothing wrong and had operated within safe and legal guidelines. "We contended the plaintiffs were neither harmed by the presence of our drilling operations nor was the value of their property diminished because of our natural gas development," Aruba said in a statement.

Confirmed: Fracking practices to blame for Ohio earthquakes
Wastewater from the controversial practice of fracking appears to be linked to all the earthquakes in a town in Ohio that had no known past quakes, research now reveals.
The practice of hydraulic fracturing, or fracking, involves injecting water, sand and other materials under high pressures into a well to fracture rock. This opens up fissures that help oil and natural gas flow out more freely. This process generates wastewater that is often pumped underground as well, in order to get rid of it. A furious debate has erupted over the safety of the practice. Advocates claim fracking is a safe, economical source of clean energy, while critics argue that it can taint drinking water supplies, among other problems. One of the most profitable areas for fracking lies over the geological formation known as the Marcellus Shale, which reaches deep underground from Ohio and West Virginia northeast into Pennsylvania and southern New York. The Marcellus Shale is rich in natural gas; geologists estimate it may contain up to 489 trillion cubic feet (13.8 trillion cubic meters) of natural gas, more than 440 times the amount New York State uses annually. Many of the rural communities living over the formation face economic challenges and want to attract money from the energy industry. Health Hazard Alert: Hydraulic Fracking Workers Suffer Silica Expopsure
OSHA and NIOSH issue hazard alert on ensuring workers in hydraulic fracturing operations have appropriate protections from silica exposure
The U.S. Department of Labor's Occupational Safety and Health Administration and the National Institute for Occupational Safety and Health today issued a hazard alert on ensuring that employers in hydraulic fracturing operations take appropriate steps to protect workers from silica exposure. Today's action, which is taken after consultation with stakeholders, including industry, meets the Obama administration's focus on ensuring that this important resource continues to be developed safely and responsibly.
The hazard alert follows a cooperative study by NIOSH and industry partners that identified overexposure to silica as a health hazard to workers conducting hydraulic fracturing operations.
As noted in the alert, respirable silica is a hazard common to many industries and industrial processes.
Because large quantities of silica sand are used during hydraulic fracturing, NIOSH began a cooperative effort in January 2010 to collect data regarding silica exposure at hydraulic fracturing operations. NIOSH worked in cooperation with oil and gas industry partners to sample the air at 11 sites in five states where hydraulic fracturing operations were taking place. NIOSH identified seven primary sources of silica dust exposure during fracturing operations and found that workers downwind of sand mover and blender operations, especially during hot loading, had the highest silica exposures.
Because large quantities of silica sand are used during hydraulic fracturing, NIOSH began a cooperative effort in January 2010 to collect data regarding silica exposure at hydraulic fracturing operations. NIOSH worked in cooperation with oil and gas industry partners to sample the air at 11 sites in five states where hydraulic fracturing operations were taking place. NIOSH identified seven primary sources of silica dust exposure during fracturing operations and found that workers downwind of sand mover and blender operations, especially during hot loading, had the highest silica exposures.
Workers who breathe silica day after day are at greater risk of developing silicosis, a disease in which lung tissue reacts to trapped silica particles, causing inflammation and scarring, and reducing the lungs’ ability to take in oxygen. Silica also can cause lung cancer and has been linked to other diseases, such as tuberculosis, chronic obstructive pulmonary disease, and kidney and autoimmune disease.
Today’s action responds to the NIOSH findings. The alert states that employers must ensure that workers are properly protected from overexposure to silica. The alert describes how a combination of engineering controls, work practices, protective equipment and product substitution, where feasible, along with worker training, can protect workers who are exposed to silica. Engineering controls and work practices provide the best protection for workers. According to the alert, transporting, moving and refilling silica sand into and through sand movers, and along transfer belts and into blender hoppers, can release dust into the air containing up to 99 percent silica that workers breathe.
“Hazardous exposures to silica can and must be prevented. It is important for employers and workers to understand the hazards associated with silica exposure in hydraulic fracturing operations and how to protect workers,” said Dr. David Michaels, assistant secretary of labor for occupational safety and health. “OSHA and NIOSH are committed to continuing to work with the industry and workers to find effective solutions to address these hazards.”
“Through partnerships, both businesses and safety professionals are able to collaborate on assessing and managing occupational safety and health risks,” said NIOSH Director John Howard, M.D. “The recommendations for protecting workers in the hazard alert are practical, evidence-based and effective solutions to help support the safe growth of American-made energy.”
“We applaud the efforts of the NIOSH NORA Council for Oil and Gas Extraction, OSHA and our partners from industry for helping to raise awareness of this hazard,” said Kenny Jordan, executive director of the Association of Energy Service Companies. “We are proud of the development of an industry focus group in cooperation with those agencies which will further explore this issue, share best practices and continue to build upon the many engineering controls currently in place and those under development over the last several years. The safety and health of our workforce is a top priority, and the industry strives to follow and improve best practices for safe operations and works closely with OSHA and NIOSH to help ensure a strong culture of safety. We look forward to sharing improvements not only within our industry, but with others as well.”
AFL-CIO Health and Safety Director Margaret Seminario stated, “The AFL-CIO strongly supports this hazard alert that provides important information to employers and workers involved in hydraulic fracturing operations regarding the serious health threat from silica exposures. It is critical that OSHA and NIOSH disseminate this information, so that immediate action can be taken to protect workers from silicosis and other silica-related diseases.”

Occupational Exposure to Silica During Hydraulic Fracking
Silica exposure has long been recognized as a compensable occupational condition in a majority of jurisdictions. A sandblaster who was required to use several 100 pound bags of silica each day and who, as a result of the inhalation of silica dust, developed silicosis was awarded compensation benefits in the form of both disability and medical benefits. Sharp v. Paterson Monument Co., 9 N.J.Super. 476, 75 A.2d 480 (Co.1950). The increased risk for occupational exposure to tuberculosis (TB) is recognized among healthcare and other workers exposed to persons with active TB and workers exposed to silica or other agents that increase the progression from latent to active TB. Fracking: US EPA To Develop Natural Gas Waterwaste Standards
The U.S. Environmental Protection Agency (EPA) is announcing a schedule to develop standards for wastewater discharges produced by natural gas extraction from underground coalbed and shale formations. No comprehensive set of national standards exists at this time for the disposal of wastewater discharged from natural gas extraction activities, and over the coming months EPA will begin the process of developing a proposed standard with the input of stakeholders – including industry and public health groups. Today’s announcement is in line with the priorities identified in the president’s Blueprint for a Secure Energy Future, and is consistent with the Secretary of Energy Advisory Board recommendations on steps to support the safe development of natural gas resources.
"The president has made clear that natural gas has a central role to play in our energy economy. That is why we are taking steps -- in coordination with our federal partners and informed by the input of industry experts, states and public health organizations -- to make sure the needs of our energy future are met safely and responsibly,” said EPA Administrator Lisa P. Jackson. "We can protect the health of American families and communities at the same time we ensure access to all of the important resources that make up our energy economy. The American people expect and deserve nothing less."
Recent technology and operational improvements in extracting natural gas resources, particularly shale gas, have increased gas drilling activities across the country. Production from shale formations has grown from a negligible amount just a few years ago to almost 15 percent of total U.S. natural gas production and this share is expected to triple in the coming decades. The sharp rise in domestic production has improved U.S. energy security and created jobs, and as with any resource the administration is committed to ensuring that we continue to leverage these resources safely and responsibly, including understanding any potential impact on water resources.
Shale Gas Standards:
Currently, wastewater associated with shale gas extraction is prohibited from being directly discharged to waterways and other waters of the U.S. While some of the wastewater from shale gas extraction is reused or re-injected, a significant amount still requires disposal. As a result, some shale gas wastewater is transported to treatment plants, many of which are not properly equipped to treat this type of wastewater. EPA will consider standards based on demonstrated, economically achievable technologies, for shale gas wastewater that must be met before going to a treatment facility.
Coalbed Methane Standards:
Wastewater associated with coalbed methane extraction is not currently subject to national standards for being directly discharged into waterways and for pre-treatment standards. Its regulation is left to individual states. For coalbed methane, EPA will be considering uniform national standards based on economically achievable technologies.
Information reviewed by EPA, including state supplied wastewater sampling data, have documented elevated levels of pollutants entering surface waters as a result of inadequate treatment at facilities. To ensure that these wastewaters receive proper treatment and can be properly handled by treatment plants, EPA will gather data, consult with stakeholders, including ongoing consultation with industry, and solicit public comment on a proposed rule for coalbed methane in 2013 and a proposed rule for shale gas in 2014.
The schedule for coalbed methane is shorter because EPA has already gathered extensive data and information in this area, EPA will take the additional time to gather comparable data on shale gas. In particular, EPA will be looking at the potential for cost-effective steps for pretreatment of this wastewater based on practices and technologies that are already available and being deployed or tested by industry to reduce pollutants in these discharges.
This announcement is part of the effluent guidelines program, which sets national standards for industrial wastewater discharges based on best available technologies that are economically achievable. EPA is required to publish a biennial outline of all industrial wastewater discharge rulemakings underway. EPA has issued national technology-based regulations for 57 industries since 1972. These regulations have prevented the discharge of more than 1.2 billion pounds of toxic pollutants each year into US waters.
