COVID-19 Public Health Emergency Lifted - Terminating The Rebuttable Presumption

At his final COVID-19 press briefing, NJ Governor Phil Murphy announced the signing of Executive Order No. 292, which lifts the COVID-19 Public Health Emergency. The order effectively ends the liberalized span of time that established a rebuttable presumption in favor of the employee as to the causal relationship between employment and COVID-19 on March 7, 2022.

Governor Murphy Reinstates Public Health Emergency Triggering Presumptions of Compensability

Governor Phil Murphy today reinstated a Public Health Emergency, effective immediately, in order to ensure that the State is able to respond to the continued threat of COVID-19 and the rapidly spreading Omicron variant. The declaration of a public health emergency by statute triggers the workers’ compensation compensability presumptions for essential workers.

NJ Governor Murphy Signs Legislation and Executive Order Ending COVID-19 Public Health Emergency

With all COVID-19 capacity restrictions on businesses and gathering limits having been lifted due to the continued improvement of New Jersey’s public health metrics, Governor Phil Murphy today signed legislation (A5820/S3866) enabling the end of the COVID-19 Public Health Emergency that has been in place since March 9, 2020. Immediately following the signing of the legislation, Governor Murphy signed Executive Order No. 244, ending the COVID-19 Public Health Emergency. Under the legislation, the majority of executive orders issued pursuant to the Public Health Emergency will expire 30 days from today.

NJ Announces Intention to End COVID-19 Public Health Emergency

As New Jersey continues to make progress in the fight against COVID-19 and with state metrics continuing to trend in the right direction, Governor Phil Murphy and his Administration have begun working with Senate President Sweeney and Assembly Speaker Coughlin on legislation that will end the COVID-19 Public Health Emergency in place since March 2020, while also ensuring that the Administration retains necessary tools to manage the ongoing threat to public health, as well as recovery and vaccination efforts.

Governor Phil Murphy today signed Executive Order No. 231. The Order extends the Public Health Emergency that was declared on March 9, 2020 through Executive Order No. 103, which was previously extended in 2020 on April 7, May 6, June 4, July 2, August 1, August 27, September 25, October 24, November 22, and December 21, and again in 2021 on January 19 and February 17. Under the Emergency Health Powers Act, a declared public health emergency expires after 30 days unless renewed.

Governor Murphy Signs Legislation to Expand Family Leave Protections During COVID-19 Outbreak

Governor Phil Murphy today signed legislation (S2374), which expands protections of the Family Leave Act to allow employees forced to take time off to care for a family member during the COVID-19 outbreak with up to 12 weeks of unpaid family leave in a 24-month period without losing their jobs.

NJ Governor Murphy Signs Legislation to Prohibit Employers from Terminating or Refusing to Reinstate an Employee Who Misses Work Due to an Infectious Disease

New Jersey Governor Phil Murphy today signed legislation (A3848), which prohibits an employer, during the ongoing Public Health Emergency and State of Emergency declared by the Governor in Executive Order 103, from terminating or refusing to reinstate an employee who has, or is likely to have, an infectious disease which requires the employee to miss time at work.
