NJ Governor Murphy Signs Legislation to Prohibit Employers from Terminating or Refusing to Reinstate an Employee Who Misses Work Due to an Infectious Disease

New Jersey Governor Phil Murphy today signed legislation (A3848), which prohibits an employer, during the ongoing Public Health Emergency and State of Emergency declared by the Governor in Executive Order 103, from terminating or refusing to reinstate an employee who has, or is likely to have, an infectious disease which requires the employee to miss time at work.

Parsippany NJ settles $54,000 workers' comp dispute with ex-construction official

Sick Leave Benefits were the subject of a $54,000 settlement where the employee received temporary disability benefits and a NJ municipality attempted to dock the employee of benefits. Today's post is shared from The Star Ledger nj.com

The township has agreed to pay its former construction official $54,063 to settle a workers' compensation dispute that surrounded sick days that were docked from his accrual bank.

"Authorities have reached a settlement agreement and release with Edward J. Corcoran, retired construction official," Councilman Paul Carifi Jr. said at the Nov. 12 council meeting.

 "He received workman's compensation, and at times he was unable to return to work. From Feb. 27 to May 31, sick-day payments were docked from his sick day accrual bank. He disputes the docking from his sick day bank. While not admitting any liability or fault, the township and Corcoran have engaged in a settlement."

Corcoran had been employed as the township's construction official since July 21, 1994, according to the Nov. 13 settlement agreement.. On Jan. 23, he was injured in a work-related incident and unable to return to work, and began receiving workers' compensation temporary disability payments, the settlement said.

On Jan. 29, Corcoran was evaluated at Concentra Urgent Care, and on Feb. 1, Concentra determined he reached maximum medical improvement — meaning treatment would no longer improve his medical condition, and benefits would be terminated.

Stable Jobs = Healthier Lives

The NewPublicHealth National Prevention Strategy series is underway, including interviews with Cabinet Secretaries and their National Prevention Council designees, exploring the impact of jobs, transportation and more on health. “Stable Jobs = Healthier Lives” tells a visual story on the role of employment in the health of our communities.
Some highlights:
  • Since 1977, the life expectancy of male workers retiring at age 65 has risen 6 years in the top half of the income distribution, but only 1.3 years in the bottom half.
  • 12.3 million Americans were unemployed as of October 2012.
  • Laid-off workers are 54% more likely to have fair or poor health, and 83% more likely to develop a stress-releated health condition.
  • There are nearly 3 million nonfatal workplace injuries each year.
  • The United States is one of the few developed nations without universal paid sick days.

Jersey City Mayor Signs Country’s Seventh Paid Sick Days Law

On Monday morning, Jersey City, NJ Mayor Steven Fulop signed the city’s paid sick days bill into law, which had been passed by the city council in September. The bill is now the seventh to become law in the country, joining New York City; Portland, OR; San Francisco, CA; Seattle, WA; and Washington, DC as well as the state of Connecticut.
Employers in the city with 10 or more workers will now have to provide them with up to five days of paid sick leave a year, with workers earning a day off for each 30 days worked. Workers at smaller businesses will have the right to earn unpaid sick days. Over 30,000 workers who previously had no access to paid sick leave are expected to benefit.
The push for paid sick days legislation at the state and city level is growing. State-wide efforts are underway in Massachusetts, New Jersey, and Vermont. Newark, NJ and Tacoma, WA are also fighting for such bills, and an effort is underway in Washington, DC to expand the city’s current policy to tipped workers.
The evidence from those places that already have laws on the books shows that they are good for business and the economy. Job growth has been stronger under Seattle’s law and business growth is also strong. San Francisco’s law has strong business support and spurred job growth. Washington DC’s had no negative impact on business, while Connecticut’s has come with little cost and big potential upsides. Meanwhile, lost...
