About the presenter

As an Occupational Hygienist for the last 25 years with the Hamilton Clinic of the Occupational Health Clinics for Ontario Workers, John has measured all kinds of hazards in workplaces ranging from offices to foundries. In the 1990’s he began to measure psychosocial hazards in office settings and among firefighters. In 2009 he started working with the Mental Injuries Tool group to devise a questionnaire to help workplace parties assess psychosocial hazards at work. John has a degree in Chemical Engineering from the University of Waterloo and Masters in Health Research Methods from the McMaster University. He has an appointment as an Assistant Professor (part-time) in the Clinical Epidemiology and Biostatistics Department.

South Carolina Man Sentenced for Knowing Endangerment by Release of Asbestos

United States Attorney Bill Nettles stated today that Scott William Farmer, age 37, of Anderson, South Carolina was sentenced Tuesday in federal court in Spartanburg, South Carolina, for Knowing Endangerment by Release of Asbestos, a violation of 42 U.S.C. § 7413(c)(5). United States District Judge Mary Geiger Lewis of Spartanburg sentenced Farmer to 41 months imprisonment and 3 years supervised release.

Evidence presented at the change of plea hearing established that between November 2012 and April 2013, Farmer and others working for Farmer demolished portions of Haynsworth Mill, located at 2115 McDuffie Street, Anderson, SC, in order to sell scrap metal from the building. The materials in the building contained hazardous levels of asbestos. Farmer was repeatedly warned by South Carolina Department of Health and Environmental Control to stop his demolition efforts because of the danger. Farmer continued tearing down the building and failed to take required precautions to safeguard his workers, individuals to whom he sold the metal from the Mill, and the public. On March 14, 2013, an Emergency Order was issued against Farmer to cease all activities on the site due to the hazardous levels of asbestos. In April of 2013, DHEC inspectors again located Farmer and another conducting demolition work on the contaminated site.

"Exposure to asbestos can cause serious health problems and in some cases may prove fatal,” said Maureen O’Mara, Special Agent in Charge of EPA’s criminal enforcement program in South Carolina. “The defendant’s actions threatened not only the environment but the safety of his workers and the surrounding community. EPA and its law enforcement counterparts take seriously our obligation to investigate these violations and prosecute to protect the public's well-being." United States Bill Nettles stated, "The United States Attorney's Office is committed to protecting the citizens of South Carolina and our natural resources from hazardous pollutants such as asbestos. Our office will continue to prioritize the environmental work we do with both federal and state agencies, to ensure that our state is protected and others are deterred from breaking the law.."

The case was investigated by agents of the Environmental Protection Agency and Department of Health and Environmental Control of South Carolina. Assistant United States Attorney Jamie Lea Schoen of the Greenville office prosecuted the case.

Chicago and 2 California Counties Sue Over Marketing of Painkillers

As the country struggles to combat the growing abuse of heroin and opioid painkillers, a new battlefield is emerging: the courts.
The City of Chicago and two California counties are challenging the drug industry’s way of doing business, contending in two separate lawsuits that “aggressive marketing” by five companies has fueled an epidemic of addiction and cost taxpayers millions of dollars in insurance claims and other health care costs.
The severity of drug abuse is well documented: Use of prescription opioids contributed to 16,651 deaths in the United States in 2010 alone, and to an estimated 100,000 deaths in the past decade. When people cannot find or afford prescription painkillers, many have increasingly turned to heroin.
The lawsuits assert that drug makers urged doctors to prescribe the drugs far beyond their traditional use to treat extreme conditions, such as acute pain after surgery or injury or cancer pain, while underplaying the high risk of addiction. Such marketing, the plaintiffs say, has contributed to widespread abuse, addiction, overdose and death.
Taking the drug makers to court recalls the tobacco liability wars of the 1990s, with government entities suing in the hope of addressing a public health problem and forcing changes from an industry they believed was in denial about the effects of its products. The tobacco settlement led to agreements by the tobacco industry to change marketing practices, which is a goal of the opioid lawsuits.

A decade ago almost all doctors kept paper charts on every patient. That is changing quickly as laptops become as common as stethoscopes in exam rooms. Recent hacking attacks have raised questions about how safe that data may be.  Here are some frequently asked questions about this evolution underway in American medicine and the government programs sparking the change.
Are my medical records stored electronically?
At least some of the information you share with your doctor or any hospital or clinic where you’ve been treated is probably stored on a computer. It's pretty common for most hospitals, clinics and doctors’ offices to digitally store your basic information including your name, address and insurance company, the same way many retailers do.


It's also likely that at least some information about your specific medical conditions is linked to that data. Health care providers have been using computers to help them get paid for decades. That means many computer-generated bills sent to you and/or your insurance company contain medical details like the conditions you were treated for, prescriptions and referrals to specialists.

Questions About Who Should Perform In-Office Surgeries

One of the hopes embedded in the health law was to expand the role of nurse practitioners and physician assistants in addressing the nation’s shortage of primary care providers. But a new study questions whether that’s actually happening in doctors’ offices.
Of the more than 4 million procedures office-based nurse practitioners and physician assistants independently billed more than 5,000 times in a year to Medicare – a list including radiological exams, setting casts and injecting anesthetic agents – more than half were for  dermatological surgeries.

That’s not surprising, according to Ken Miller, president of the American Association of Nurse Practitioners, because when patients are older, skin problems such as “boils, skin tags and warts” are pretty  typical.
“I think that’s where you’re going to see the majority of procedures that are occurring both in primary care and in some of the other specialties like geriatric clinics,” he said.
The Aug. 11 study, published in the JAMA Dermatology analyzing 2012 Medicare claims, is suggesting that nurse practitioners and physician assistants should face higher regulation if performing surgical procedures.

DuPont wants Pompton Lakes cleanup eased

DuPont wants to clean up its former Pompton Lakes munitions plant — contaminated with a litany of elements that can cause cancer and other illnesses — using far weaker standards than the state usually requires, a strategy that echoes prior attempts by polluters to push for less extensive cleanups at other sites in North Jersey.
In its proposal, which was obtained by The Record through a federal public records request, DuPont says it would leave some of the contaminated soil in place and cap it. Other sections would be excavated, with some of that soil sealed in two old tunnels carved out of a ridge on the property.
The plan is drawing strong criticism from state and federal environmental agencies that must sign off before any action can take place. Negotiations with the company are ongoing.
The proposal is also sparking concern from neighbors whose homes now sit over a plume of groundwater contaminated by toxic substances that migrated from the plant.

The Trucking Industry Needs More Drivers. Maybe It Needs to Pay More.

Swift Transportation’s 20,000 workers haul goods in almost 14,000 big-rig trucks that travel the interstates and back roads of the United States every day. The company’s performance is closely tied to the nation’s economy, which has been looking increasingly sunny lately.
So it was surprising last month when Swift’s stock plummeted nearly 18 percent in a single day. The tumble came for an odd reason. It wasn’t because there was too little business — but rather, too much.
“We were constrained by the challenging driver market,” the company said in its quarterly earnings announcement. “Our driver turnover and unseated truck count were higher than anticipated.”
In other words, Swift had plenty of customers wanting to ship goods. But in a time of elevated unemployment, it somehow couldn’t find enough drivers to take those goods from Point A to Point B. How is that possible? The reasons for that conundrum tell us a great deal about what has been ailing American workers and why a full-throated economic recovery has been so slow in coming.
Consider this: The American Trucking Associations has estimated that there was a shortage of 30,000 qualified drivers earlier this year, a number on track to rise to 200,000 over the next decade. Trucking companies are turning down business for want of workers.

Colgate Total Ingredient Linked to Hormones, Cancer Spotlights FDA Process

The chemical triclosan has been linked to cancer-cell growth and disrupted development in animals. Regulators are reviewing whether it’s safe to put in soap, cutting boards and toys. Consumer companies are phasing it out. Minnesota voted in May to ban it in many products.
At the same time, millions of Americans are putting it in their mouths every day, by way of a top-selling toothpaste that uses the antibacterial chemical to head off gum disease -- Colgate-Palmolive Co.’s Total.
Total is safe, Colgate says, citing the rigorous Food and Drug Administration process that led to the toothpaste’s 1997 approval as an over-the-counter drug. A closer look at that application process, however, reveals that some of the scientific findings Colgate put forward to establish triclosan’s safety in toothpaste weren’t black and white -- and weren’t, until this year, available to the public.
Colgate’s Total application included 35 pages summarizing toxicology studies on triclosan, which the FDA withheld from view. The agency released the pages earlier this year in response to a lawsuit over a Freedom of Information Act request. Later, following inquiries from Bloomberg News, the FDA put the pages on its website.

Taking Job-Driven Training to Scale

Connecting the right worker with the right job is key to our vision of opportunity for all. At the Labor Department, it’s how we’re working to help more people punch their ticket to the middle class.
That’s why we’re investing in proven strategies that connect ready-to-work Americans with ready-to-be-filled jobs. As part of this effort, in April, we announced the availability of funds through a new Job-Driven National Emergency Grants program to help dislocated workers who have lost a job through no fault of their own.
And this week, I am very excited to announce the awards – nearly $155 million to 32 states, Puerto Rico and the Cherokee Tribal Nation – to help fund work-based training programs, like Registered Apprenticeship and on-the-job training, which have a proven record of success. That’s $155 million to give workers the chance to “learn and earn,” developing skills while earning a paycheck. With on-the-job training, employers who participate can use this funding to offset the cost of training and temporarily cover a portion of the wages for the people they hire.
We know these programs work. Earlier this year, I met with Gary Locke from New Hampshire, who – after being laid off for more than a year – found a job through the state’s innovative on-the-job training program. The funds we’ve announced this week will expand programs that helped Gary to more states around the country.

House Passes Wasserman Schultz Longshore Harbor Workers' Compensation Clarification Act: Protecting Jobs and Keeping Workers Covered

Washington, D.C.– The Longshore Harbor Workers’ Compensation Clarification Act, introduced by Rep. Debbie Wasserman Schultz (FL-23), and passed by the House of Representatives today, reinstated congressional intent to ensure that workers in the recreational marine repair industry have adequate workers’ compensation coverage. This legislation provides a more clear definition of a recreational vessel which allows small businesses in the marine repair industry to forgo duplicative insurance policies while ensuring these small businesses, 95% of which have fewer than 10 employees, can adequately protect their employees without incurring exorbitant costs. 
In 2009, Congress passed Section 803 of the American Recovery and Reinvestment Act, which expanded an existing exception that allowed more recreational marine repair workers to receive workers’ compensation coverage under state law rather than under the Longshore Harbor Workers Compensation Act. This was necessary because repair workers were simply not buying the more expensive longshore policies and were thus left uncovered. Unfortunately, new regulations were issued in 2011 that adopted a definition of a recreational vessel that was far more complicated and onerous than the existing law. In doing so, this new regulatory definition ran counter to what Congress intended.

Big Oil's New Pitch: Fracking Means Never Having To Fear Putin

The Obama administration, meanwhile, is weighing plans to streamline DOE approval of liquefied natural gas export facilities (though some industry insiders doubt it will speed up the process). The issue has also played into the secret negotiations over a sweeping US-European Union trade agreement. According to an EU memo leaked to the Washington Post earlier this month, Europe is pressing the United States to lift its longstanding restrictions on fossil fuel exports and make a "legally binding commitment" to allow oil and gas to flow to EU countries.
Even if the market shifts, most European countries aren't equipped to handle large-scale liquefied natural gas imports—and won't be for years.
But the argument behind these measures may be a red herring. Speeding up exports would be boon to industry profits, given that natural gas costs at least three times more overseas than it does in the United States. However, according to environmentalists and industry analysts, it would do little to break Europe's dependence on Russia. "Folks who were in favor of accelerating liquefied natural gas exports anyway have seized upon the Ukraine crisis as yet another argument for why we should be doing it," says Edward Chow, a former Chevron executive and an expert on international energy markets. A few days ago I wrote a post about generic painkillers and the fact that doctors themselves—who should know better—often don't use them. "If physicians aren't really sold on generics in their own personal lives," I asked, "does this mean they're not really sold on them in their professional lives too?"
Well, perhaps I got it backwards. A friend sent me a link to a Forbes article from last year about the FDA retracting its approval of a generic version of Wellbutrin:
The episode is bringing momentum to a movement that has been quietly building among many doctors and medical societies that are increasingly willing to ask a question that borders on heresy: Are generics really identical to the branded products they are meant to replicate? To a surprising degree, they say, the answer is no.
If you’re a layperson, this is the way you probably think of generics: They’re the exact same products in different packaging; generics companies can sell such medications for a fraction of the cost of the originals because they don’t have to spend huge sums on drug development and marketing....But generic drugs diverge from the originals far more than most of us believe.
....The FDA’s rules effectively acknowledge that. The agency’s definition of bioequivalence is surprisingly broad: A generic’s maximum concentration of active ingredient in the blood must not fall more than 20% below or 25% above that of the brand name....

Fatigue is inevitable during any long work day, and sometimes coffee is just not enough to get most people through their midday slump. British sleep experts are now saying that bosses should allow their employees a nap during the day and the option to make their own schedule to help increase productivity. Millions of people fail to get enough sleep during their week and are forced to compensate over the weekend when their work has already suffered.
“It’s best to give your brain downtime,” Vincent Walsh, professor of human brain research at University College London told Cheltenham Science Festival. “I have a nap every afternoon. It’s only since the industrial revolution we have been obsessed with squeezing all our sleep into the night rather than having one or two sleeps through the day.”
A recent study conducted by the Centers for Disease Control and Prevention’s National Institute of Occupational Safety and Health revealed that around 41 million American workers are not getting the seven to nine hours of sleep recommended by the National Sleep Foundation. Sleep deprivation is putting these people and their co-workers in danger of serious injury or death.
