FDA Orders Surveillance of Hip Implants

Hip replacements are utilized through the workers' compensation medical delivery system in an effort to cure and relieve medical conditions arising out of employment injuries and exposures. The US Food and Drug Administration (FDA) has recently announced that it is widening its roll in monitoring the hip implants. This follows a recent recall of defective hip implants.
"The FDA is continuing to gather and review all available information about currently marketed metal-on-metal hip systems, including information related to adverse events that may be associated with increase levels of cobalt and chromium in the bloodstream. To that end, on May 6, 2011 the FDA issued orders for postmarket surveillance studies to manufacturers of metal-on-metal hip systems. The FDA sent 145 orders to 21 manufacturers. Manufacturers will be required to submit a research protocol to the FDA that addresses specific safety issues related to these devices. Data from the studies conducted will enable the agency to better understand these devices and their safety profiles.

Contractor to Remove PCB From Park in Bogota NJ

Waterside Construction LLC, the company suspected of bringing in tainted material while cleaning up the contaminated Veterans Field, will remain the contractor on the project and pay to have the latest contaminants removed.

“I believe we need to work within the contract,” borough attorney Philip Boggia advised the council during a special meeting Wednesday. “Our experts are satisfied, at least at this point, that [the situation is] manageable and that all steps that need to be put in place have been put in place.”

Some residents have called for the firing of the contractor, but Boggia said that by having Waterside stay on and pay for the removal of the contaminants, the cleanup would take months. The alternative would be to sue the contractor for defaulting on work, which could lead to years of legal wrangling, he said.

The attorney also said the contract with Waterside includes a provision for the contractor to address improper materials brought onsite. “Defective work shall be made good; and unsuitable materials may be rejected,” states a clause in the contract

“The contractor has acknowledged responsibility and is willing to pay the cost of whatever is required to remediate the situation,” Boggia said.

Radiation Near Japanese Plant’s Tanks Suggests New Leaks

A crisis over contaminated water at Japan’s stricken nuclear plant worsened on Saturday when the plant’s operator said it had detected high radiation levels near storage tanks, a finding that raised the possibility of additional leaks.


The operator, Tokyo Electric Power Company, or Tepco, said it had found the high levels of radiation at four separate spots on the ground, near some of the hundreds of tanks used to store toxic water produced by makeshift efforts to cool the Fukushima Daiichi plant’s three damaged reactors. The highest reading was 1,800 millisieverts per hour, or enough to give a lethal dose in about four hours, Tepco said.

Mercury to be Removed by US EPA From Pompton River in NJ

The US EPA has announce that mercury, a hazardous substance, that was dischardged by EI DuPont in the Pompton River in NJ will be removed. For decades it has been known that mercury exposure causes illness and injury to workers.

The U.S. Environmental Protection Agency today announced its plan to remove mercury contamination from the sediment of the Acid Brook Delta of Pompton Lake in Pompton Lakes, New Jersey to levels that meet stringent standards to protect people’s health and the environment. The plan will go into effect as a modification of a permit, which legally requires the E.I. du Pont de Nemours & Company, Inc. to fund and perform the work. Under the permit modification, the EPA will require DuPont to dredge at least 100,000 cubic yards of mercury contaminated sediment from the bottom of a 40-acre area of Pompton Lake and remove at least 7,800 cubic yards of contaminated soil from a shoreline area of the lake affected by DuPont’s past discharges. All of the sediment and soil will be sent to a licensed disposal facility.

Mercury in the sediment and soil can build up in the tissue of fish and other wildlife and pose a threat to people who eat them. Exposure to mercury can damage people’s nervous systems and harm the brain, heart, kidneys, lungs and immune systems.

“The removal of mercury-contaminated sediment from Pompton Lake is a major step toward the recovery of the lake and the protection of people’s health,” said EPA Regional Administrator Judith A. Enck. “The expanded dredging and other revisions in the final cleanup plan reflect the EPA’s commitment to protecting public health and improving environmental quality in Pompton Lakes.”

In November 2011, the EPA proposed a preliminary permit modification to remove contaminated sediment from the bottom of Pompton Lake and encouraged the public to comment on it. A public hearing on the proposed permit modification was held in January 2012. The final permit modification announced today incorporates changes that were made in response to comments from the public and the U.S. Fish and Wildlife Service and additional technical information received from DuPont after the proposed permit modification was issued. A public meeting to discuss the permit modification for the Acid Brook Delta of Pompton Lakes will be held on January 15, 2013.

Under the final permit modification, the area of sediment that will be removed has been expanded by approximately 35% and sediment sampling is required to identify additional areas of the lake that may require the removal of mercury-contaminated sediment. In addition, DuPont is required to implement long-term monitoring of the effectiveness of the dredging, restore the soil between Lakeside Avenue and the edge of the lake, and perform an ecological risk assessment to determine whether additional action may be needed in the future. DuPont will be required to develop work plans for these requirements, which must be submitted to the EPA for approval. The cleanup will be financed and conducted by DuPont with EPA oversight.

The E.I. du Pont de Nemours & Company, Inc. operated the Pompton Lakes Works facility, located at 2000 Cannonball Road, from 1902 to April 1994. Products manufactured at the facility included explosive powder containing mercury and lead, detonating fuses, electric blasting caps, metal wires and aluminum and copper shells. The manufacturing operations and waste management practices contaminated soil, sediment and ground water both on and off-site. Lead and mercury from its operations were released into Acid Brook, which flows through the eastern part of the facility and discharges into the Acid Brook Delta of Pompton Lake. DuPont’s operations also contaminated the ground water with chlorinated volatile organic compounds, such as tetrachloroethylene, trichloroethylene, cis 1,2-dichloroethylene and vinyl chloride.

The cleanup of the Acid Brook Delta requires a modification of the permit under the federal Resource Conservation and Recovery Act. The final permit modification will become effective on February 4, 2013 pending any requests for appeal submitted prior to that date.

Plans to clean up the remaining areas of contamination will be proposed through future permit modifications after ongoing investigations by DuPont have been completed and reviewed by the EPA and the New Jersey Department of Environmental Protection. Opportunities for public participation will continue to be provided through regular updates, public notices and public meetings.

To Promote Wellness, Public Health Departments Are Launching Apps. Will They Work?

The Alabama Department of Public Health is venturing into the mobile universe as the first state with a health app for residents.

“Normally Alabama comes in last when it comes to health indicators, but we were one of the first states to be on Facebook and Twitter and YouTube. This is just another goal for us,” says Jennifer Pratt Sumner, the director of the digital media branch of the department.

The app, which is free to download from Google Play or iTunes, brings all of the social media feeds put out by the various public health divisions into one place. It also provides health news alerts and information about wellness events, such as the annual Alabama Youth Rally. Some recent tips included educational conferences open to the public, and tips on safely consuming shellfish in the state.

“As more and more Americans use their smartphones to gather health information, I think we’ll see a greater number of health departments rolling out their own apps,” says Alexandra Hughes, an account director at Ogilvy Public Relations Worldwide, who wrote an analysis on social media effects entitlted “Using Social Media Platforms to Amplify Public Health Messaging” [PDF].

Former workers, whistleblowers shed light on nuclear site safety setbacks

RICHLAND, Wash. – On the banks of the Columbia River, miles of open land sit undeveloped behind barbed wire fences. A handful of mysterious structures dot the landscape, remnants from the early days of the Cold War. Passing by the old Hanford nuclear production complex can feel like a journey into the past.

Known simply as Hanford, workers here produced plutonium for the world’s first atomic bomb and for many of the nation’s current nuclear warheads. The site was first developed in 1943 as part of the Manhattan Project and ceased plutonium production nearly 50 years later, leaving behind 53 million gallons of highly radioactive waste. Spanning 586 square miles, it is now ground zero for the largest cleanup project in America.
For 27 years, Mike Geffre was part of that effort, working in an area known as the tank farms: 177 massive underground storage tanks, which hold up to 1 million gallons each of the country’s most toxic nuclear waste.
First built in the 1940s, many of the original single-shell tanks leaked and contaminated the local groundwater. But starting in the 1960s, the federal government built stronger double-shell tanks that were supposed to hold the waste securely until it could be treated and sent to a deep geological repository for final keeping. Geffre, who maintained instruments used to monitor chemical and radioactive waste, spent much of his time looking for leaks in the supposedly unleakable tanks.

Time to Lab Test Chemicals

The Toxic Substances Control Act (TSCA) was enacted in 1974 and has not kept up with the time. Of the 80,000 chemical substances in use  it has test only 200 and regulated only 5. The United Steelworkers joined forces with the Learning Disabilities Association, the Cancer Institute, and the Pennsylvania Nurses Association to call for reforms of the federal Toxic Substances Control Act needed to ensure the health and safety of America's workers and families.


The 5 substances that TSCA mandates regulations for are all known carcinogens: Asbestos, Hexavalent Chromium, Vinyl Chloride, Trichloethylene, Methyene Chloride and Dicloromethene. 


Since 1976 chronic and terminal diseases have increased: Leukemia +20%; Breast Cancer 40% with a risk factor increase from 1 in 10 women to 1 in 8 women; and asthma +200%. Additionally, major increases in conceiving and making pregnancy, birth defects and autism have been reported.


Chronic conditions now result in 70% of all deaths and 75% of all health costs. Direct health care costs from cancer alone, in 2008, was $93.2 Billion of the total health care costs in the US that amounted to $304 Billion.


A recent report reveals the inadequacies of the TSCA and urges an update. As medical science continues to investigate these medical conditions, it is critically important that Congress updates the TSCA and requires better regulation 


Dr. Maryann Donovan, associate director of research services for the University of Pittsburgh's Cancer Institute and director of the Center for Environmental Oncology stated, "It's not a matter of whether we test toxic chemicals. It's a matter of how we test them. Right now we test them in the bodies of our children, our consumers, our workers, ourselves. It's time to start testing chemicals in the lab, and to take action before anyone is harmed."

New Jersey: Toxic legacy remains

One of government's most basic responsibilities is protecting public health. That's not happening in Ringwood with a notorious old dump that is now a Superfund site.

Rather than remove more than 100,000 tons of toxic waste dumped about 40 years ago by the Ford Motor Co., the borough wants to build a recycling center on top of it. That's bad enough.

What's even worse is that the state Department of Environmental Protection is going along with the plan, according to a letter the agency sent recently to an attorney representing the borough. Nearby residents should be outraged that borough and state officials are seemingly so unconcerned about a real risk to public health.

The dumping site, which is off Peters Mine Road and near where many members of the Ramapough Lenape Nation live, has had a particularly sordid history.

Ford, which once had a plant in nearby Mahwah, began disposing paint sludge in the wooded terrain in the late 1960s, when such dumping was not uncommon. The federal Environmental Protection Agency oversaw a cleanup of the site in the early 1990s and, in 1994, proclaimed the area free of contaminants. That was not true. After a series by The Record in 2005 found that huge amounts of waste were still in the ground, properly cleaning up the area was again an issue.

The borough's plan is to cover the contaminated area with a 2-foot layer of soil and synthetic material. A recycling center would then be constructed on top. It is not unusual for old dumps, or...

EPA considering NJ Hackensack River for cleanup plan


Today, Hackensack Riverkeeper formally petitioned the United States Environmental Protection Agency (EPA) to study whether the main stem of the Hackensack River should be listed under the federal Superfund law. The drastic action was taken on behalf of the tidal reaches of river that stretch for twenty-two miles from Van Buskirk Island in Oradell, NJ to the river’s terminus at Newark Bay. Bottom sediments throughout that area are contaminated with a long list of toxic chemicals and heavy metals. 

For over two hundred years industrial interests used the Hackensack River as a convenient dumping ground. As a result, there are five current Superfund sites on the river or its tributaries, and literally hundreds of sites within its watershed (drainage basin) that the New Jersey Department of Environmental Protection (DEP) lists as “Known Contaminated Sites.” In DEP’s list of state waters unsafe or fishing or swimming, the Hackensack is cited as unacceptably contaminated with toxins including DDT, PCBs, Dioxin, Chromium, Copper, and Mercury among other pollutants.

In an acknowledgment that the Hackensack River remains seriously polluted with a century of industrial waste, the federal government will consider adding the river to the federal Superfund list, a program reserved for the country’s most contaminated sites.

Nearby Superfund sites
Numerous Superfund sites as well as other contaminated sites — all former industrial facilities — have likely contributed to the contamination in the Hackensack River. The Superfund sites are:
  • The 40-acre Ventron/Velsicol site in Wood-Ridge had an old processing plant where mercury was removed from discarded lab equipment, batteries and other devices. Mercury levels on the site were more than 128 times higher than the state threshold for non-residential cleanups. The cleanup involved carting more than 40,000 cubic yards of contaminated soil to a hazardous waste facility in Canada.
     
  • The 74-acre Universal Oil site in East Rutherford had PCB levels as high as 5,810 parts per million — the state’s soil cleanup standard for PCBs is one part per million. The site cleanup involved removing 950,000 gallons of contaminated water from a lagoon and 6,600 cubic yards of soil. Other soil contaminated with PCBs and lead was capped.

Contaminated Soil and Debris to Be Removed From Superfund Site in South Plainfield, New Jersey

The U.S. Environmental Protection Agency has proposed a plan to address contaminated soil and debris at the Woodbrook Road Dump Superfund site in South Plainfield, New Jersey. Previous dumping of old electrical capacitors at the site has contaminated some of the soil with polychlorinated biphenyls (PCBs). PCBs are chemicals that persist in the environment and can affect the immune, reproductive, nervous and endocrine systems. Under the plan proposed today, contaminated soil and debris will be dug up and removed.

“This was a poorly run dump in the vicinity of the Dismal Swamp – a natural wildlife refuge and an important wetland,” said EPA Regional Administrator Judith A. Enck. “Some material that caused contamination, including electrical capacitors, has already been removed and now we will get rid of the contaminated soil. I encourage the public to give the EPA their input on this proposed cleanup plan.”

The EPA will hold a public meeting on August 26, 2013 to explain the proposed plan and is encouraging public comments. The meeting will be held at 7:00 p.m. at the South Plainfield Municipal Building courtroom at 2480 Plainfield Avenue in South Plainfield, NJ. Comments will be accepted until September 16, 2013.

The Woodbrook Road Dump Superfund site is located on land that was used as a dump in the 1940s and 1950s for both industrial waste and household waste until it was shut down by the state of New Jersey in 1958. Among the materials disposed of at the site were old electrical capacitors, which contained PCBs and had contaminated the soil. Under EPA oversight, the current owner of the property, Texas Eastern Transmission Corporation (TETCO), removed a number of PCB-contaminated capacitors, secured the site and placed warning signs around the area. The EPA added the Woodbrook Road Dump site to the Superfund list in 2003.

Under the EPA’s cleanup plan, as much as 120, 000 cubic yards of contaminated soil and debris will be dug up and disposed of at a facility licensed to receive the waste. All PCB-contaminated soil and debris above 1 part per million from both the Eastern and Western dump areas will be disposed of off-site. Wetland areas that are disturbed during the work will be restored. Ground water at the site is not contaminated with site-related chemicals. The EPA will conduct a review every five years to ensure the effectiveness of the cleanup.

The Superfund program operates on the principle that polluters should pay for the cleanups, rather than passing the costs to taxpayers. After sites are placed on the Superfund list of the most contaminated waste sites, the EPA searches for parties responsible for the contamination and holds them accountable for the costs of investigations and cleanups.

EPA Orders Public Water System on Indian Reservation in Riverside County to Address Arsenic in Drinking Water

The U.S. Environmental Protection Agency last week ordered D&D Mobile Home Park to address violations of the Safe Drinking Water Act. D&D, located on the Torres Martinez Desert Cahuilla Indian Reservation in Riverside County, was found to have high levels of arsenic in its public system that provides drinking water to its 300 mobile park residents.

The order requires D&D to come into compliance with the arsenic drinking water standard as well as conduct more consistent arsenic monitoring.Sampling data showed arsenic at concentrations as high as 0.059 milligrams per liter—almost six times the EPA’s maximum contamination levels for arsenic. Sampling data also showed the presence of coliform bacteria. D&D is a privately owned and operated system on the Indian Reservation. 

The order requires D&D to submit, within 90 days, a written plan for EPA review that will demonstrate the mobile park’s strategy to bring the water system into compliance with the federal arsenic standard by December 31, 2014. Quarterly arsenic water sampling is also required. 

The penalty for not complying with the terms of the order can be up to $37,500 per day based on federal statutory law.

Train Carrying Deadly PVC Crashes In NJ Sickens Workers / Residents

A train carrying deadly Polyvinyl Chloride (PVC) crashed in NJ this morning when a bridge it was traveling on collapsed. The train containing highly toxic cargo crashed while crossing a creek near the Delaware River. 

It has been reported that at least 71 people are being treated for respiratory distress and residents have been ordered to remain indoors. The train remains dangling from the collapsed bridge and and chemicals continue to leak into the creek.

Most vinyl chloride is used to make polyvinyl chloride (PVC) plastic and vinyl products. Acute (short-term) exposure to high levels of vinyl chloride in air has resulted in central nervous system effects (CNS), such as dizziness, drowsiness, and headaches in humans. Chronic (long-term) exposure to vinyl chloride through inhalation and oral exposure in humans has resulted in liver damage. Cancer is a major concern from exposure to vinyl chloride via inhalation, as vinyl chloride exposure has been shown to increase the risk of a rare form of liver cancer in humans. EPA has classified vinyl chloride as a Group A, human carcinogen.

Acute Effects: Acute exposure of humans to high levels of vinyl chloride via inhalation in humans has resulted in effects on the CNS, such as dizziness, drowsiness, headaches, and giddiness. Vinyl chloride is reported to be slightly irritating to the eyes and respiratory tract in humans. Acute exposure to extremely high levels of vinyl chloride has caused loss of consciousness, lung and kidney irritation, and inhibition of blood clotting in humans and cardiac arrhythmias in animals. Tests involving acute exposure of mice have shown vinyl chloride to have high acute toxicity from inhalation exposure.

Chronic Effects(Noncancer): Liver damage may result in humans from chronic exposure to vinyl chloride, through both inhalation and oral exposure. A small percentage of individuals occupationally exposed to high levels of vinyl chloride in air have developed a set of symptoms termed “vinyl chloride disease,” which is characterized by Raynaud’s phenomenon (fingers blanch and numbness and discomfort are experienced upon exposure to the cold), changes in the bones at the end of the fingers, joint and muscle pain, and scleroderma-like skin changes (thickening of the skin, decreased elasticity, and slight edema). CNS effects (including dizziness, drowsiness, fatigue, headache, visual and/or hearing disturbances, memory loss, and sleep disturbances) as well as peripheral nervous system symptoms (peripheral neuropathy, tingling, numbness, weakness, and pain in fingers) have also been reported in workers exposed to vinyl chloride. Animal studies have reported effects on the liver, kidney, and CNS from chronic exposure to vinyl chloride. EPA has established a Reference Concentration (RfC) of 0.1 milligrams per cubic meter, and a Reference Dose (RfD) of 0.003 milligrams per kilogram per day for vinyl chloride. Reproductive/Developmental Effects: Several case reports suggest that male sexual performance may be affected by vinyl chloride. However, these studies are limited by lack of quantitative exposure information and possible co-occurring exposure to other chemicals. Several epidemiological studies have reported an association between vinyl chloride exposure in pregnant women and an increased incidence of birth defects, while other studies have not reported similar findings. Epidemiological studies have suggested an association between men occupationally exposed to vinyl chloride and miscarriages in their wives’ pregnancies although other studies have not supported these findings. Testicular damage and decreased male fertility have been reported in rats exposed to low levels for up to 12 months. Animal studies have reported decreased fetal weight and birth defects at levels that are also toxic to maternal animals in the offspring of rats exposed to vinyl chloride through inhalation.

Cancer Risk: Inhaled vinyl chloride has been shown to increase the risk of a rare form of liver cancer (angiosarcoma of the liver) in humans. Animal studies have shown that vinyl chloride, via inhalation, increases the incidence of angiosarcoma of the liver and cancer of the liver. Several rat studies show a pronounced early-life susceptibility to the carcinogenic effect of vinyl chloride, i.e., early exposures are associated with higher liver cancer incidence than similar or much longer exposures that occur after maturity. EPA has classified vinyl chloride as a Group A, human carcinogen. EPA uses mathematical models, based on animal studies, to estimate the probability of a person developing cancer from breathing air containing a specified concentration of a chemical.

EPA has calculated an inhalation unit risk estimate of 8.8 × 10-6 (µg/m3)-1 for lifetime exposure to vinyl chloride.
