Justice for asbestos victims

Dear Lord Freud The 2013 Mesothelioma Bill in its current form is unfair and punitive. It imposes arbitrary deadlines on already-vulnerable people, depriving them of vital compensation.We call on you to amend the bill to ensure that everyone who is affected by asbestos exposure get 100% of the compensation owed to them.
Anyone who is exposed to asbestos at work, and subsequently develops mesothelioma cancer, is entitled to compensation from their employer. However, many people can’t be paid compensation because they can’t track down the company who insured their employer at the time of exposure, which could have been many decades ago.The government is currently legislating to set up a scheme where they will compensate those affected if they can’t find the relevant insurer. However, they’ve imposed a cut-off date of 25th July 2012 so anyone diagnosed before that date can’t claim from the new scheme. This arbitrarily punishes people struggling with life-threatening illnesses.And they’ve capped the compensation someone can claim to 70% of the average compensation paid through the civil court system. This robs people of vital funds they need at a difficult time of their lives. This government is crippling individuals, to save themselves pennies.Sign this petition and demand fair, compassionate treatment for all asbestos-affected people.

Contractor to Remove PCB From Park in Bogota NJ

Unsafe disposal of contaminated contaminated soil and rock has historically been a common practice. Not only are employees exposed but so is the general public, including children. Today's post is shared from northjersey.com

Waterside Construction LLC, the company suspected of bringing in tainted material while cleaning up the contaminated Veterans Field, will remain the contractor on the project and pay to have the latest contaminants removed.

“I believe we need to work within the contract,” borough attorney Philip Boggia advised the council during a special meeting Wednesday. “Our experts are satisfied, at least at this point, that [the situation is] manageable and that all steps that need to be put in place have been put in place.”

Some residents have called for the firing of the contractor, but Boggia said that by having Waterside stay on and pay for the removal of the contaminants, the cleanup would take months. The alternative would be to sue the contractor for defaulting on work, which could lead to years of legal wrangling, he said.

The attorney also said the contract with Waterside includes a provision for the contractor to address improper materials brought onsite. “Defective work shall be made good; and unsuitable materials may be rejected,” states a clause in the contract

“The contractor has acknowledged responsibility and is willing to pay the cost of whatever is required to remediate the situation,” Boggia said.

Richland: EPA fines DOE $115,000 over Hanford asbestos issue | Hanford news | Tri-CityHerald.com

The Department of Energy is being fined $115,000 for violations related to asbestos management after demolishing Hanford nuclear reservation buildings in 2009 and 2010.
The EPA inspector general issued an early-warning report in December 2011, saying that removal of asbestos in certain ways at Hanford and elsewhere potentially threatened health and safety.
The Hanford violations were discovered as a result of an EPA inspection and evaluation of compliance at Hanford with asbestos management rules that followed in 2012.
In March DOE and its regulators agreed to restrict the use of heavy equipment to demolish buildings that still have asbestos out of concern for worker health.

Asbestos Can Take Your Breath Away, Forever

The time is now for the Senate to unanimously support the passage of the Safe Chemicals Act (S.847). We need to do more to protect our children from BPAs, fire retardants and other dangerous toxins in our world.

What many don’t realize is that asbestos is still legal and lethal in theUnited States, tragically impacting families. I know because it happened to us.


I remember the day when my husband AlanAlan Was diagnosed with malignant pleural mesothelioma as if it were yesterday.  We had never heard of mesothelioma, and we were devastated when we learned that there is no cure.  Our daughter was only ten years old when we began our arduous family battle to fight mesothelioma and work with Congress To ban asbestos.

Scientific improprieties in the asbestos industry funded research of McGill professor

Here is a powerful, detailed and damning scientific analysis of  improprieties in the research of Prof. J.C. McDonald on Quebec asbestos miners – The Past is Prologue, Universities in Service to Corporations: The McGill-QAMA Asbestos Example.
This analysis was presented by Prof. David Egilman at the McGill asbestos conference on October 1, 2013. It is clearly presented and well worth reading. At the conference, no response was provided to the damning information that Prof. Egilman put forward.
Prof. McDonald’s research was financed with one million dollars by the Quebec Asbestos Mining Association (QAMA). Prof. McDonald used his research to promote the use of chrysotile asbestos around the world. His research continues today to be used by the global asbestos industry to promote the sale and use of chrysotile asbestos. It was used, for example, by the global asbestos lobby at the May 2013 Rotterdam Convention conference to help defeat the listing of chrysotile asbestos as a hazardous substance.
McGill continues to state that Prof. McDonald’s research was conducted “according to the rigorous scientific standards for which McGill is known”. McGill has not however addressed the detailed and damning evidence that Prof. Egilman has put forward.

Proposed Asbestos Legislation Called "A Subterfuge" to Alter the Civil Justice System


H.R. 982, the “Furthering Asbestos Claim Transparency (FACT) Act of 2013.


"Asbestos defendants and insurance companies, under the guise of creating increased 
“transparency,” are introducing proposed legislation in state legislatures to grant solvent asbestos  defendants new rights and advantages to be used against asbestos victims in court. Some of these  bills would also burden the asbestos trusts with unnecessary reporting requirements, slowing  their ability to pay claims, and further draining them of the resources needed to make their  already diminished payments. In general, the bills are an attempt to change the rules of the tort system to provide defendants with an advantage, using the existence of the trusts and claims of a lack of “transparency” as a subterfuge."

US Asbestos Imports Increases in 2011

The United States has yet to ban asbestos, a known carcinogen, and in 2011 the amount of asbestos that the US imports increased according to US government statistics. It is axiomatic, that the legacy from the this increase of asbestos imports will cause an increase in asbestos related illness in the US 30 years down the road as asbestosis and malignancies such as lung cancer and mesothelioma rise.

The following statement was issued today by Linda Reinstein, Co-Founder, President & CEO of the Asbestos Disease Awareness Organization, regarding the 2012 United States Geological Survey report about the dramatic increase in asbestos importation to the United States:

"As a Mesothelioma widow and asbestos awareness advocate, I was appalled and shocked to discover today that the 2012 United States Geological Survey (USGS) Mineral Commodity Summaries reported asbestos consumption from January through July of 2011 to be 1,100 metric tons; however, when comparing a previous report from January through July of 2010, asbestos consumption was reported to be 820 metric tons. This difference of 280 metric tons represents a 25% increase in consumption. For more than three decades, asbestos has been a known human carcinogen, yet occupational and environmental exposure continues throughout the United States.


There is no safe limit for asbestos exposure. Asbestos should be banned in the US.  The introduction and use of asbestos fiber into the US environment will only perpetuate a legacy of fatal disease for future Americans.

"Domestic Production and Use: Asbestos has not been mined in the United States since 2002. The United States is dependent on imports to meet manufacturing needs. Asbestos consumption in the United States was estimated to be 1,100 tons, based on asbestos imports through July 2011. Roofing products were estimated to account for about 60% of U.S. consumption; the chloralkali industry about 35%; and unknown applications, 5%."

Why is the US Still in the Asbestos Business?

The US still has not banned asbestos. The recently released US Geological Survey just published the latest statistics reporting that 1,040 metric tons of asbestos, a know carcinogen and the cause of mesothelioma, a rare and fatal disease, was consumed in 2010 in the US. Roofing products account for about 72% of US consumption and other applications 28%.

Where does it come from? Our northern neighbor, Canada. Asbestos has not been mined in the US since 2002. The US imports 99% of the asbestos it consumed from Canada. In fact the US consumed 1,040 metric tons in 2010 which was an increased from 869 metric tons in 2009. 

If Congress really wanted to improve the health of both its citizens and the economy, it would take appropriate action to ban asbestos in the US.

Asbestos Disease Claims Continue to Surge

A recent analysis reveals that mesothelioma claims continue to surge. Insurance companies such as Hartford and AIG forced to increase reserves. Exposures from the 1970's are now manifesting in disease and claims for benefits. 


Mesothelioma is a rare but fatal condition caused by exposure to asbestos fiber. It is a condition that they remain dormant for as long as 30 years or more before manifesting symptoms.


Asbestos was used as an insulation product and for structural support i many products including ceiling title and other construction material. It was used to insulate boilers and other heat generating devices.

Quebec Does the Dirty Deed - Funds Asbestos Production

After years of controversy, the Quebec government has agreed to give $7.5 million dollars to Jeffrey Mine so that they can dig up more asbestos and spread the cancer causing agent throughout the world. This repugnant and unconscionable action is nothing less than immoral

"Reopening the Jeffrey Mine will create 425 full-time jobs in Asbestos," the minister said.  Yes this will definitely a job creation bill, in the saddest way possible. It would also require massive amount of medical teams to treat asbestos victims throughout the world, as Quebec exports this poison worldwide.  

It is time that asbestos was banned worldwide. Yes, the United States should show by example!
