Employment Status An Issue: Who's their real boss

Who's your boss?
For an increasing number of American workers, it's a hard question to answer. To cut costs and avoid liability, more companies are hiring workers on a temporary or contract basis. More than 17 million people, 12 percent of the U.S. workforce, are now employed as temps, contract or freelance workers.
If you're a temp, which company is responsible for your pay, your schedule — and your right to a safe workplace? The agency that hired you, or the company that hired the agency?
The right answer, according to a group of temporary workers at a recycling plant in Milpitas, is both. They get paid by one company — Leadpoint Business Services — but work under the direction of a different one — Browning Ferris Industries (BFI), which operates the facility.
When temps at Milpitas filed a union organizing petition last year, they asked the National Labor Relations Board to recognize both Leadpoint and BFI as joint employers. Seeking representation by the Teamsters, the workers argued that since two companies share control over the work environment, both should come to the bargaining table.
The regional office of the NLRB disagreed, finding Leadpoint alone was the employer. The temporary workers have appealed. My organization — the National Council for Occupational Safety and Health — recently joined an amicus brief in support of their claim that both companies are joint...

ObamaCare's Union Favor

The Affordable Care Act's greatest hits keep coming, and one that hasn't received enough attention is a looming favor for President Obama's friends in Big Labor. Millions of Americans are losing their plans and paying more for health care, and doctors are being forced out of insurance networks, but a lucky few may soon get relief.
Earlier this month the Administration suggested that it may grant a waiver for some insurance plans from a tax that is supposed to capitalize a reinsurance fund for ObamaCare. The $25 billion cost of the fund, which is designed to pay out to the insurers on the exchanges if their costs are higher than expected, is socialized over every U.S. citizen with a private health plan. For 2014, the fee per head is $63.
The unions hate this reinsurance transfer because it takes from their members in the form of higher premiums and gives to people on the exchanges. But then most consumers are hurt in the same way, and the unions have little ground for complaint given that ObamaCare would not have passed in 2010 without the fervent support of the AFL-CIO, the Teamsters and the rest.
The unions ought to consider this tax a civic obligation in solidarity with the (uninsured) working folk they claim to support. Instead, they've spent most of the last year demanding that the White House give them subsidies and carve-outs unavailable to anyone else.
But don't expect ObamaCare favors unless you helped to re-elect the President. In an aside in a Federal Register...

California Applicants' Attorneys Association Affiliates With Labor

Teamsters and Workers’ Compensation Attorneys Affiliate To Strengthen Political Action Team


SACRAMENTO, CA - The International Brotherhood of Teamsters (IBT), AFLCIO, and the California Applicants’ Attorneys Association (CAAA) today announced a new Affiliation Agreement. CAAA has affiliated with the IBT’s Joint Councils No. 7 and 42, and its California Teamsters Public Affairs Council. The two organizations have agreed to coordinate their activities and pursue mutual interests relating to policy and politics.

“The Affiliation Agreement between the Teamsters and the California Applicants’ Attorneys Association helps both improve our abilities to meet the needs of our respective memberships,” said Randy Cammack, International Vice President of the IBT and Co-Chair of the California Teamsters Public Affairs Council. “The Teamsters will benefit from CAAA’s expertise in advising us on workers’ compensation policy and workplace safety issues. CAAA will benefit from our presence throughout the state at the local level, and our expertise in working for improved public policy relating to working people,” added Rome Aloise, IBT Vice President and the other Co-Chair of the California Teamsters Public Affairs Council.

“Our members represent tens of thousands of working Californians, and we have always worked closely with organized labor on behalf of those injured on the job. Our Affiliation with the Teamsters will provide our members and their clients with an even more powerful voice on their behalf,” said Barry Hinden, president of CAAA. “This Affiliation will harness the power of our two organizations to focus
on state and federal issues that jointly affect our members, including legislation, public policy and political action.”

“Our organization of professionals will remain autonomous and self-governing,” said Hinden. “We are excited to join with others who share our goals and objectives and look forward to an even closer relationship with all of organized labor. This is an opportunity to become even stronger advocates for Californians injured on the job.”

Cammack, Aloise, and Hinden said the partnership between CAAA and the IBT is part of an effort by both organizations to build bridges and form new alliances. The Teamsters, for example, have organized or affiliated airline pilots and other whitecollar professionals. CAAA has embarked on a new initiative to build bridges to like-minded organizations in organized labor, and the civil rights and consumer advocacy communities.
