Documents Show General Motors Kept Silent on Fatal Crashes

The car crash that killed Gene Erickson caught the attention of federal regulators. Why did the Saturn Ion he was traveling in, along a rural Texas road, suddenly swerve into a tree? Why did the air bags fail? General Motors told federal authorities that it could not provide answers.
But only a month earlier, a G.M. engineer had concluded in an internal evaluation that the Ion had most likely lost power, disabling its air bags, according to a subsequent internal investigation commissioned by G.M.
Now, G.M.'s response, as well as its replies to queries in other crashes obtained by The New York Times from the National Highway Traffic Safety Administration, casts doubt on how forthright the automaker was with regulators over a defective ignition switch that G.M. has linked to at least 13 deaths over the last decade.
They provide details for the first time on the issue at the heart of a criminal investigation by the Justice Department: whether G.M., in its interaction with safety regulators, obscured a deadly defect that would also injure perhaps hundreds of people.


The company repeatedly found a way not to answer the simple question from regulators of what led to a crash. In at least three cases of fatal crashes, including the accident that killed Mr. Erickson, G.M. said that it had not assessed the cause. In another fatal crash, G.M. said that attorney-client privilege may have prevented it from answering. And in other cases, the automaker was more blunt, writing, “G.M....

On Sunday, a commuter train derailed on its way to Manhattan, killing four people and injuring more than 60. It’s not clear exactly what caused the accident, although some reports indicate that the conductor may have been nodding off at the wheel. That’s sparked a broader conversation about sleep deprivation as a public health concern.
Indeed, by some researchers’ estimations, “drowsy driving” is just as dangerous as drunk driving. Both can double the risk of a traffic accident, and the National Highway Traffic Safety Administration estimates that about 100,000 of the annual car crashes in the U.S. directly result from driver fatigue. Teens are particularly at risk for driving while drowsy, a reality that’s led some parents to push to start high school later in the day.
The issue is especially serious among transportation workers, who often literally have hundreds of lives in their hands. According to the Huffington Post, multiple public transportation accidents — not just on trains, but also on buses and airplanes — have been attributed to sleep-deprivation over the past decade.
According to a 2012 survey from the National Sleep Foundation, about one fourth of these workers admit that a lack of sleep has affected their recent job performance. And many of them also acknowledge that this issue...

Living with Safety this Thanksgiving

Motor vehicle accidents are among the highest causes of injuries to workers. The suggestions issued by the NJ State Police provide a helpful guidance for a safe Thanksgiving Day Weekend.Today's post is shared from njsp.org.
The weather is getting nasty just in time for the busiest travel holiday of the year.  With a little planning and a focus on safety, you can make your Thanksgiving travels the most uneventful of your holiday activities.  When gearing up for your trip, prepare for winter even though the calendar still says fall.  That means filling your tank, checking your tire pressure and wiper blades, and packing a blanket, snacks & water in case of a breakdown.  And to keep your blood pressure in check, just leave early because your trip will take much longer than usual because of traffic and road conditions.
In relation to roadway safety, the 2012 Thanksgiving holiday was no reason to celebrate in New Jersey with eight fatal accidents and 10 deaths over the holiday period. Alcohol or drugs was a factor in six of those fatalities.  Four of those killed were pedestrians.  These are sobering statistics that we do not want to repeat this year.
“It doesn’t matter if you’re driving five minutes up the road or through several states, the basics of safety remain the same,” said Colonel Rick Fuentes, Superintendent of the New Jersey State Police.  “Troopers and other law enforcement officers will have zero tolerance for those who create dangers on the roads.”
Distracted driving and aggressive driving are at the top of the list for causing motor vehicle crashes.  Troopers will be using a variety of marked and unmarked vehicles to look for texting drivers, unbelted occupants (especially children), speeders, and of course, intoxicated drivers. 
New Jersey’s “Move Over” law is still unheeded by many drivers.  This law helps protect roadside emergency workers and vehicles including police, fire, medical services, highway maintenance, tow trucks, and official motorist aid vehicles displaying amber, red, or blue emergency lights.  Where possible, drivers are required to move over to create an empty lane next to the emergency vehicle.  When safely changing lanes is not possible, drivers must slow down below the posted speed limit prior to passing emergency vehicles. Drivers should also be prepared to stop, if necessary.
Increase your travel safety by using these common sense tips:
  • Make sure your cell phone is fully charged
  • Carry a flashlight with new batteries.
  • Bring bottles of water and snacks such as protein bars.
  • Insist that all vehicle occupants use seatbelts.
  • Don’t drive drowsy.  The symptoms of driving tired are similar to those of driving under the influence of drugs or alcohol.  Make sure you get enough rest.  Use service areas to pull over, stretch your legs, or grab a cup of coffee.
  • Steer clear of “road ragers.”  Challenging an aggressive driver for a position is a dangerous way to get to your destination a few seconds sooner. 
  • Use a designated driver.  If alcohol figures into your Thanksgiving plans, plan to have one driver stay sober.
  • Prepare before you drive. Map your route; fill your tank; check your tire pressure, lights and wiper blades.  These simple steps may save you more than just time on the highways.
More than 100 additional state troopers will be supplementing the usual patrols.  These troopers are looking for specific violations that lead to crashes, including driving while intoxicated, aggressive driving, and using handheld phones/tablets.
The official Thanksgiving driving period begins at 6:00 p.m. on November 27, and runs through 6:00 a.m. on December 2.

Why Texting-While-Driving Bans Don't Work

Lost in the clamor for stricter distracted-driving laws, a study from April 2013 found discouraging patterns in the relationship between texting bans and traffic fatalities.
As one might expect, single occupant vehicle crashes dip noticeably when a state legislature enacts a texting and driving ban. But the change is always short-lived, according to this study, which examined data from every state except Alaska from 2007 through 2010. Within months, the accident rate typically returned to pre-ban levels.
The researchers, Rahi Abouk and Scott Adams of University of Wisconsin-Milwaukee, attribute this pattern to the "announcement effect," when drivers adjust their behavior to compensate for a perceived law enforcement threat—only to return to old habits when enforcement appears ineffectual. In other words, drivers might dial back their texting when they hear about a ban, but after they succumb to the urge once or twice and get away with it, they determine it's okay and keep doing it.
"It's different than drunk driving," Adams said. Identifying intoxicated drivers is relatively easy, "you can give somebody a breathalyzer, you can have checkpoints." But with texting, "it's really hard [for policemen] to know" if someone's been texting.
No one denies the dangers of texting while driving. In fact, 95 percent of AAA survey (PDF) respondents said texting behind the wheel was a "very" serious threat to their personal safety. But 35 percent of the same...

Short Sleepers Most Likely to Be Drowsy Drivers

Federal data suggests that 15 to 33 percent of fatal automobile crashes are caused by drowsy drivers, but very little research has addressed what factors play a role in operating a vehicle in this impaired state. New research from the Perelman School of Medicine at the University of Pennsylvania is revealing that short sleepers, those who sleep less than six hours per night on average, are the most likely to experience drowsy driving, even when they feel completely rested. The study is published in the October issue of the journal Accident Analysis and Prevention.
Falling asleep at the wheel is a major cause of road accidents. It might even be more of a problem than drunk driving, since it is responsible for more serious crashes per year,” said corresponding study author Michael Grandner, PhD, instructor in Psychiatry and member of the Center for Sleep and Circadian Neurobiology. “We already know that people who are sleep deprived in the laboratory have impaired driving performance, but we haven’t been able to better define what sleep profiles and patterns put drivers in the general population at the highest risk.”
Previous research on drowsy driving has utilized results from laboratory experiments, but the new study, utilizing data from the CDC’s 2009 Behavioral Risk Factor Surveillance System (BRFSS), evaluated individuals in the general population. Click It or Ticket Campaign --- May 23--June 5, 2011

In 2009, motor vehicle crashes resulted in approximately 23,000 deaths to passenger vehicle occupants (excluding motorcyclists), and 2.6 million occupants were treated for injuries in emergency departments in the United States. Many motor vehicle accidents occur in the course of employment and are the subject of workers' compensation claims. Although seat belt use in the United States is now estimated at 85%, millions of persons continue to travel unrestrained. Using a seat belt is one of the most effective means of preventing serious injury or death in the event of a crash. Seat belts saved an estimated 12,713 lives in 2009, but almost 4,000 additional lives could have been saved if every occupant had been buckled up.

Click It or Ticket, a national campaign coordinated annually by the National Highway Traffic Safety Administration (NHTSA) to increase the proper use of seat belts, takes place May 23--June 5, 2011. Law enforcement agencies across the nation will participate by conducting intensive, high-visibility enforcement of seat belt laws. Campaign activities will focus on young adult men (aged 18--34 years) and on nighttime travel. OSHA To Fine Employers for Distracted Driving Accidents

OSHA has announced an aggressive program to combat "The Number 1 Killer of Workers," Distracted Driving. The announcement was made today by Dr. David Michaels, Assistant Secretary of Labor of the Occupational Safety and Health (OSHA).


The enforcement program was described by Michaels  at a symposium on the prevention of Occupationally-Related Distracted Driving conference hosted by Johns Hopkins University. Following the policy announced by President Obama in his Executive Order banning texting while driving, OSHA is calling upon all employers to ban texting while driving.


It is the intention of OSHA to provide education and enforcement on the issue of distracted driving. OSHA will investigate motor vehicle accidents, including cell phone records, and will issue citations and fine employers where an accident involved texting while driving. While OSHA has juridiction over employers, and not employees,  it hopes to encourage all employers to declare motor vehicles a "text free zone."

Lloyds Report Targets Potential Cell Phone Liability

Yet another reason why employers should be concerned with the risks of distracted driving has been reported by Lloyds of London. A recent report considers the electromagnetic fields (EMF) from mobile phones a potential risk to health.

The report reviews the medical causation issues involving a myriad of conditions ranging from brain cancer (acoustic neuromas and gliomas) to central nervous system effects, as well as reproduction and biological development consequences of EMF exposure over the long term. In reviewing historical litigation trends, the Lloyds report compares the legal consequences of asbestos exposure and the development of mesothelioma and analyzes the complicity and enormous liability that resulted from corporate concealment and conspiracy.

With over 4.3 billion mobile phones in use worldwide as of June 2009, this report increases the concern of employers who are already experiencing increased liability because of the use of cell phones while driving. A major initiative is underway by US Department of Transportation to curtail the use of cell phone by employee while driving because of the increase risk of motor vehicle accidents.

As workers’ compensation insurance carriers have already been challenged by significant losses as a result of occupational exposure to asbestos, the Lloyds report may encourage employers to restrict the use of a cell phone, except when used in a safe and protected manner.

Cell Phone Safety and Workers Compensation

Workers' Compensation benefits may soon be denied to employees involved in motor vehicle accidents because of the unauthorized use of cell phones while driving within the course of their employment. As the US Department of Transportation (USDOT) continues to educate Americans with overwhelming statistical evidence that distracted driving is a major cause of accident, the denial of benefits to cell phone users may become a major incentive to create a safer work environment.

Meanwhile, the US Department of Transportation is leaning toward banning all use of cell phones by drivers. At the second national USDOT summit on the increased hazards of the use of cell technology  a major campaign was launched to encourage employers to outright  ban the use of cell phones by employees while working.

Employers have become increasingly concerned over employee "cognitive distraction" caused by the use of cell phones in motor vehicles as more data has become available associating driver cell phone use with accidents. Methods of enforcement will include the use of traffic cameras as the system already hss the capability of detecting drivers who are using telephones while driving. Evidentially, telephone billing records produced post accident can be used to corroborate the fact that an employee was using a telephone while working.

The precedent of using the workers compensation acts to make occupational environments safer is already established. The denial of workers' compensation benefits for unsafe actions by employees has previously been incorporated into law and has been an economic incentively for employers to reduce costs. Employees who are under the influence of drugs or alcohol, and those who fail to use employer provided safety devices, have already been denied benefits in some jurisdictions.
