DOL Inspector General Issues Report on OSHA’s COVID-19 Inaction

The US Department of Labor Office of Inspection General (OIG) reported that a study of OSHA’s actions during the COVID-19 Pandemic put workers’ safety at risk.


WHY OIG CONDUCTED THE AUDIT 

The COVID-19 pandemic has raised specific concerns about the health and safety of workers and the measures OSHA has taken to ensure employers are mitigating employees’ risk of exposure to the virus at workplaces.



  

Due to the pandemic, OSHA has received a surge of complaints in a matter of months, while garnering the attention of Congress, labor unions, and media with requests to act swiftly on behalf of the 130 million workers at more than 8 million worksites nationwide whom OSHA is responsible for protecting. 


WHAT OIG DID 

We conducted this audit to answer the following question:

 

What plans and guidance has OSHA developed to address challenges created by COVID-19, and to what extent have these challenges affected OSHA’s ability to protect the safety of workers and its workforce? 


To answer this question, we reviewed guidance, public laws, and state standards; conducted interviews; and researched complaint and enforcement data.

OSHA has taken a series of actions to address its challenges and has issued guidance in response to the pandemic. However, increased complaints, reduced inspections, and most inspections not being conducted onsite subject employees to greater safety risk. 


Since the start of the pandemic, OSHA has received a sudden influx of complaints, and as a means of reducing person-to-person contact, has reduced the number of its inspections, particularly onsite inspections. Compared to a similar period in 2019, OSHA received 

15 percent more complaints in 2020, but performed 50 percent fewer inspections. As a result, there is an increased risk that OSHA is not providing the level of protection that workers need at various job sites. During the pandemic, OSHA issued 295 violations for 176 COVID-19 related inspections, while 1,679 violations for 756 COVID-19 related inspections were issued under State Plans.

OSHA Cites New Jersey Contractor For Disregarding Fall Protection Requirements

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has cited Brutus Construction Inc. for exposing employees to fall and other safety hazards at a worksite in Souderton, Pennsylvania. The company faces $181,699 in penalties.

OSHA fines South River, NJ, masonry contractor nearly $91,000 for fall, scaffold hazard

The U.S. Department of Labor's Occupational Safety and Health Administration has cited South River-based Mr. Concrete Corp. with four repeat and five serious safety violations, including scaffold and fall hazards, found at a Maywood work site. OSHA's February inspection was initiated in response to imminent fall hazards observed by an OSHA compliance officer.

The repeat violations, with $69,300 in fines, involve exposure to fall hazards of approximately 20
feet while working from a scaffold lacking a fall protection system; workers on a scaffold more than 10 feet above a lower level while not protected from falling to that lower level; tubular welded frames and panels not properly braced; no limited access zone established during masonry wall construction; and lack of appropriate ladders, stair towers, walkways or access to scaffold platforms more than 2 feet above or below a point of access. The same violations were cited in 2010. A repeat violation is issued when an employer previously has been cited for the same or a similar violation of a standard, regulation, rule or order at any other facility in federal enforcement states within the last five years.

The serious violations, with a $20,790 penalty, involve failing to guard the point of operation of a mortar mixer, ensure electrical equipment was properly grounded, ensure makeshift devices were not used to increase scaffold height, and to properly install toeboards on the scaffold edge. A serious citation is issued when there is substantial probability that death or serious physical harm could result and the employer knew, or should have known, of the hazard.

Laundry in Paterson NJ Fined $165,000 by OSHA for Safety and Health Violations


Commercial laundries are the cause of many workers' compensation claims from toxic exposures and machine accidents. Enforce of safety and health laws goes a long way to prevent accidents at commercial laundry facilities.

The U.S. Department of Labor's Occupational Safety and Health Administration has cited Brite Services Inc., doing business as Star Laundry, for 39 serious safety and health violations found at its commercial laundry facility in Paterson. Inspectors were prompted by a complaint alleging the company would not allow workers to leave the building during an emergency. Proposed penalties total $164,700.

OSHA found electrical hazards and an obstructed and improperly marked exit route. Additional violations include: allowing employees to potentially be struck by traffic while transporting laundry bins from one building to another while crossing a public street; failing to provide a cover and guardrails for open pits; provide a handrail for the stairway; evaluate the workplace for permit-required confined spaces; post signs informing workers of confined spaces; and develop a written confined space permit program. Other violations include failing to establish an energy control program for performing maintenance/servicing work; train power industrial truck operators; take powered industrial trucks in need of repair out-of-service; insulate or cover steam pipes less than 7 feet from the floor; properly guard machines; implement a hearing conservation program for workers exposed to noise levels at 88 and 89 decibels; ensure safety goggle usage; provide an unblocked eyewash station; develop a written hazard communication program; and provide hazard communication training.

"The vast number and range of safety and health hazards observed by OSHA at this facility indicates the lack of a functioning safety and health management system," said Lisa Levy, director of OSHA's area office in Hasbrouck Heights. "Each employer is responsible for ensuring a safe and healthful work environment, which Brite Services did not do. This company has the opportunity now to educate itself, correct these hazards and protect its workers."

Brite Services Inc. has 15 business days from receipt of the citations to comply, request an informal conference with the OSHA area director in Hasbrouck Heights, or contest the citations and proposed penalties before the independent Occupational Safety and Health Review Commission.

Warehouse Workers Are At Risk By Company Safety Violations

Warehouse worker suffer unique risks associated with their employment. Many warehouse workers suffer injuries at work that lead to seriously disabling Worker’s Compensation claims. U.S. Department of Labor's Occupational Safety and Health Administration  (OSHA) has taken a major step in enforcing regulations in Jersey City,New Jersey, in an effort to make the work environment safer.

OSHA has cited Continental Terminals Inc. for nine serious and two willful safety violations at the company's Jersey City facility. Inspectors were notified of alleged hazards at the facility while they were inspecting another Continental facility in Kearny. Proposed penalties total $130,900.
The willful violations involve not protecting workers by allowing them to ride on the forks of forklifts, where they were exposed to falls of 10 feet, and permitting them to work on elevated platforms devoid of guardrails. A willful violation is one committed with intentional knowledge or voluntary disregard for the law's requirements, or with plain indifference to worker safety and health. The citations carry $98,000 in penalties. The serious violations include having exit doors that were sealed shut, allowing damaged powered industrial trucks to be operated, stacking materials insecurely, not having a hazard communication program, using damaged electrical cords and not labeling electrical panels. A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known. The citations carry $32,900 in penalties.

"Because fall hazards are among the leading cause of death among workers, it is vital that employers provide workers with proper fall protection," said Kris Hoffman, director of OSHA's Parsippany Area Office. "Employers are responsible for ensuring safe and healthful workplaces, and will be held legally accountable when they fail to do so."


Continental Terminals Inc. is a coffee and cocoa warehouse business that employs 10 workers at its Jersey City site; it was recently fined $162,400 by OSHA for safety violations at its Kearny site. The company has 15 business days from receipt of the citations to comply, request an informal conference with the OSHA area director, or contest the findings before the independent Occupational Safety and Health Review Commission.In April, Secretary of Labor Hilda L. Solis announced a campaign to provide employers and workers with lifesaving information and educational materials about working safely from ladders, scaffolds and roofs in an effort to prevent deadly falls in the construction industry. In 2010, more than 10,000 construction workers were injured as a result of falling while working from heights, and more than 250 workers were killed. OSHA's fall prevention campaign was developed in partnership with the National Institute of Occupational Safety and Health and NIOSH's National Occupational Research Agenda program. OSHA cites Wal-Mart Super Center for repeat and serious safety hazards - proposes $52,600 in fines


The U.S. Department of Labor's Occupational Safety and Health Administration has cited Wal-Mart Stores Inc. for alleged repeat and serious violations of workplace safety standards at the Wal-Mart Super Center store located at 139 Merchant Place in Cobleskill. The retailer faces a total of $52,600 in proposed fines following inspections by OSHA's Albany Area Office.


OSHA found that emergency exit access from a receiving and storage area was obstructed by the storage of pallets containing merchandise and equipment, and employees were not able to safely operate pallet jacks in aisles and passageways that were obstructed by stacked merchandise. In addition, portable fire extinguishers were not mounted and located in safely accessible areas, and the lack of a protective fitting and strain relief for an electrical conduit entering a control box presented an electrical hazard.


These conditions resulted in the issuance of citations with $48,200 in proposed fines for three repeat violations. A repeat violation exists when an employer previously has been cited for the same or a similar violation of a standard, regulation, rule or order at any other facility in federal enforcement states within the last five years. In this case, OSHA had previously cited Wal-Mart for similar hazards at stores in Newington, Conn.; Chelmsford and West Boylston, Mass.; Centralia and Joliet, Ill.; Coshocton, Ohio; and Lewisville, Texas.


"The recurring nature of these hazards is disturbing and needs to be effectively addressed," said Kimberly Castillon, OSHA's area director in Albany. "An employer with multiple locations, such as Wal-Mart, needs to ensure that hazards are identified, corrected and prevented at all of its workplaces."


Additionally, a citation with a $4,400 fine has been issued for a serious violation involving a lack of eye, face and hand protection as well as safety training for employees operating cardboard balers. A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.


"One step an employer can take to protect its workers against on-the-job hazards is to develop and maintain an effective illness and injury prevention program in which management and employees work together to proactively identify and prevent hazardous conditions," said Robert Kulick, OSHA's regional administrator in New York.


Arkansas-based Wal-Mart has 15 business days from receipt of its citations and proposed penalties to comply, meet with OSHA's area director or contest the findings before the independent Occupational Safety and Health Review Commission.
