Mechanic can sue Ford for further damages in asbestos case

The state Supreme Court on Wednesday allowed a former Bay Area service station owner to seek additional damages from Ford Motor Co. for exposing him to brake-lining asbestos that has afflicted him with terminal cancer.
A jury awarded Patrick Scott $1.5 million in damages and legal costs against Ford in November 2012. Wednesday's order allows him to ask another jury for punitive damages. Scott and his wife, Sharon, have settled claims against other automakers for undisclosed amounts.
Scott worked in a Navy shipyard, where he was also exposed to asbestos, before opening his first service station in Sausalito in 1965. He leased an Atlantic Richfield station in San Francisco in 1970, then moved his business to a Beacon station in St. Helena in 1977.
He stopped working in 2011 after being diagnosed with mesothelioma, an incurable form of lung cancer that is caused by asbestos but typically does not show up until decades after exposure.
Asbestos has long been used in the linings of motor vehicle brakes and clutches and is still used in brake pads, though it is banned in some other products. Scientists had established its connection to cancer by the mid-1950s, but the federal government did not regulate workplace asbestos exposure until 1971.
According to court records, Ford mentioned asbestos in one of its publications in 1975 but did not put warnings on brake cartons until at least 1980. A Ford internal investigation cited by Scott's lawyers found mesothelioma among company...

Asbestos Victims Ask Yale to Revoke an Honorary Degree


An Italian organization representing victims of asbestos exposure has asked Yale University to rescind an honorary degree awarded to the owner of the company they once worked for.

In the mid-1970s, Swiss billionaire Stefan Schmidheiny took over his family’s business. The Eternit company had plants around the world that produced asbestos cement products. The largest was in Casale Monferrato, Italy.

Connecticut lawyer Christopher Meisenkothen represents shipyard workers and boiler makers who worked with asbestos here in the U.S., and later developed diseases like asbestosis, lung cancer, and mesothelioma. He is handling the Italian request to Yale, pro bono.

Meisenkothen described notes from an Eternit company meeting in the 1970s. "Clearly," he said, "they were acknowledging in 1976 that the workers were at risk. The plant continued to use asbestos for many years after that. They could have given the workers respiratory protection, [or] installed exhaust fans. And the worker testimony from workers at the time consistently indicates that there were no serious precautions taken in the plant."

Two years later, Schmidheiny began to dismantle the company's asbestos processing concern. He went on to use his wealth to support eco-friendly sustainable development in other parts of the world.

In 2012, Schmidheiny was tried in absentia in Italy. He was found guilty of causing the deaths of thousands of people in Casale Monferrato, and has been sentenced to 18 years...

Re “The Asbestos Scam,” by Joe Nocera (column, Dec. 3): Asbestos manufacturers filed for bankruptcy after juries across the nation assessed punitive damages for concealing the asbestos-disease hazards from their workers and the users of their products for 50 years.

Mr. Nocera makes light of a claimant’s assertion that she was subjected to asbestos exposure because she lived in a house with relatives who worked with asbestos, but numerous studies link household exposure (often called “bystander exposure”) with asbestos disease. He denies that there is conclusive proof that cigarette smoking and asbestos exposure combine to increase the risk of lung cancer, despite the findings of epidemiological studies from around the world.

Chief among them is the investigation by Dr. Irving J. Selikoff, former director of the Mount Sinai School of Medicine’s Environmental Sciences Laboratory, and Dr. E. Cuyler Hammond, former vice president for epidemiology and statistics of the American Cancer Society, who showed that nonsmoking asbestos workers died of lung cancer seven times more often than people in the general population, and whose calculations suggested that asbestos workers who smoked had more than 90 times the risk of dying of lung cancer as men who neither worked with asbestos nor smoked.

Scientific Evidence to Support 'Seven Generations' future thinking; our toxic chemical exposures may harm our great-grandchildren

Thinking beyond today and beyond specific employee exposure is critical for the analysis of the consequences of our environment and health. One would think that we woud have learned of the serious medical problems caused by the consequences of being a household contact to an asbestos worker. Proven has been the causal relationship to asbestosis, lung cancer and mesothelioma. The future effects of industrial and environmental pollution are the subject of an insightful article by Jennifer Sass, Ph.D., Senior Scientist, Natural Resources Defense Council (NRDC) and, Professorial Lecturer, George Washington University (SEIU Local 500).
Native American tribes hold dear the concept of seven generations planning, that the impact of decisions should be considered out seven generations into the future, about 150 years. The idea is that our decisions today should consider the potential benefits or harm that would be felt by seven future generations. While such future-thinking has obvious ethical and moral value, it seems that it may also have scientific validity.
A recent article by Washington State University biologist, Dr. Michael Skinner and his scientific team provides evidence from rat studies that male infertility can result from an exposure to the pesticide vinclozolin. What’s the catch? The pesticide exposure was not to the infertile rat, but to its great grandmother, three generations earlier!

Overlooked Lymph Nodes in Rib Cage Have Prognostic Power for Mesothelioma Patients

A potential tool to diagnosis and treatment mesothelioma has been reported.

For the first time, researchers from the Perelman School of Medicine at the University of Pennsylvania have shown the predictive power of a group of overlooked lymph nodes--known as the posterior intercostal lymph nodes--that could serve as a better tool to stage and ultimately treat patients with malignant pleural mesothelioma.

The findings were presented October 28 at the 15th World Conference on Lung Cancer.
Physicians look to lymph nodes to stage essentially all cancers, including mesothelioma. The presence or absence of metastatic cancer cells in lymph nodes affects prognosis and also typically dictates the optimal treatment strategy. But posterior intercostal lymph nodes, which are located between the ribs near the spine, have not been previously used to stage or guide treatment of malignant pleural mesothelioma or any other cancer.

Delivering High-Quality Cancer Care: Charting a New Course for a System in Crisis

In the United States, approximately 14 million people have had cancer and more than 1.6 million new cases are diagnosed each year. By 2022, it is projected that there will be 18 million cancer survivors and, by 2030, cancer incidence is expected to rise to 2.3 million new diagnoses per year. However, more than a decade after the IOM first studied the quality of cancer care, the barriers to achieving excellent care for all cancer patients remain daunting. Therefore, the IOM convened a committee of experts to examine the quality of cancer care in the United States and formulate recommendations for improvement. Delivering High-Quality Cancer Care: Charting a New Course for a System in Crisis presents the committee’s findings and recommendations.


The committee concluded that the cancer care delivery system is in crisis due to a growing demand for cancer care, increasing complexity of treatment, a shrinking workforce, and rising costs. Changes across the board are urgently needed to improve the quality of cancer care. All stakeholders – including cancer care teams, patients and their families, researchers, quality metrics developers, and payers, as well as HHS, other federal agencies, and industries – must reevaluate their current roles and responsibilities in cancer care and work together to develop a higher quality cancer care delivery system. Air pollution a leading cause of cancer - U.N. agency

The air we breathe is laced with cancer-causing substances and is being officially classified as carcinogenic to humans, the World Health Organization's cancer agency said on Thursday.

The International Agency for Research on Cancer (IARC) cited data indicating that in 2010, 223,000 deaths from lung cancer worldwide resulted from air pollution, and said there was also convincing evidence it increases the risk of bladder cancer.
Depending on the level of exposure in different parts of the world, the risk was found to be similar to that of breathing in second-hand tobacco smoke, Kurt Straif, head of the agency's section that ranks carcinogens, told reporters in Geneva.
"Our task was to evaluate the air everyone breathes rather than focus on specific air pollutants," deputy head Dana Loomis said in a statement. "The results from the reviewed studies point in the same direction: the risk of developing lung cancer is significantly increased in people exposed to air pollution."
Air pollution, mostly caused by transport, power generation, industrial or agricultural emissions and residential heating and cooking, is already known to raise risks for a wide range of illnesses including respiratory and heart diseases.
Research suggests that exposure levels have risen significantly in some parts of the world, particularly countries with large populations going through rapid industrialization, such as China.

Outdoor air pollution: a leading environmental cause of cancer deaths

The specialized cancer agency of the WHO, the International Agency for Research on Cancer (IARC), announced that it has classified outdoor air pollution as carcinogenic to humans. The IARC evaluation concluded that there is sufficient evidence that exposure to outdoor air pollution causes lung cancer.

The specialized cancer agency of the World Health Organization, the International Agency for Research on Cancer (IARC), announced today that it has classified outdoor air pollution as carcinogenic to humans (Group 1).

After thoroughly reviewing the latest available scientific literature, the world’s leading experts convened by  the IARC Monographs Programme concluded that there is sufficient evidence that exposure to outdoor air  pollution causes lung cancer (Group 1). They also noted a positive association with an increased risk of  bladder cancer.

Particulate matter, a major component of outdoor air pollution, was evaluated separately and was also
classified as carcinogenic to humans (Group 1).

The IARC evaluation showed an increasing risk of lung cancer with increasing levels of exposure to
particulate matter and air pollution. Although the composition of air pollution and levels of exposure can vary dramatically between locations, the conclusions of the Working Group apply to all regions of the  world.

A major environmental health problem Air pollution is already known to increase risks for a wide range of diseases, such as respiratory and heart diseases. Studies indicate that in recent years exposure levels have increased significantly in some parts of the world, particularly in rapidly industrializing countries with large populations. The most recent data indicate that in 2010, 223 000 deaths from lung cancer worldwide resulted from air pollution.

The most widespread environmental carcinogen “The air we breathe has become polluted with a mixture of cancer-causing substances,” says Dr Kurt Straif, Head of the IARC Monographs Section. “We now know that outdoor air pollution is not only a major  risk to health in general, but also a leading environmental cause of cancer deaths.”

The IARC Monographs Programme, dubbed the “encyclopaedia of carcinogens”, provides an authoritative source of scientific evidence on cancer-causing substances and exposures. In the past, the Programme evaluated many individual chemicals and specific mixtures that occur in outdoor air pollution. These included diesel engine exhaust, solvents, metals, and dusts. But this is the first time that experts have classified outdoor air pollution as a cause of cancer.

“Our task was to evaluate the air everyone breathes rather than focus on specific air pollutants,” explains Dr Dana Loomis, Deputy Head of the Monographs Section. “The results from the reviewed studies point in the same direction: the risk of developing lung cancer is significantly increased in people exposed to air pollution.”

Mesothelioma: Two Groundbreaking Trials Into Treatments for Asbestos-Related Cancer

University of Leicester researchers are leading two major trials into treatments for a type of cancer which affects those exposed to asbestos.

Professor Dean Fennell, of the University's Department of Cancer Studies and Molecular Medicine, is leading two groundbreaking trials into mesothelioma -- a form of lung cancer strongly linked with exposure to asbestos.

Mesothelioma most commonly starts in the inner lining of the chest wall, causing it to thicken, reducing lung capacity -- which in turn puts a strain on other organs including the heart.
Since the 1960s, it has been known that the disease can be triggered by the inhalation of asbestos fibres.

Despite the UK's ban on asbestos issued in 1985, the number of deaths caused by the disease each year has grown from 153 in 1968 to 2,321 in 2009 -- the highest incidence in the world.

This number is set to continue to rise sharply over the next 20 years, with a peak coming in 2020.
Two studies involving the University of Leicester aim to test new potential treatments which could improve survival and quality of life for mesothelioma patients.

Meso2, a study funded by Synta Pharmaceuticals, aims to test the effectiveness of a drug called ganetespib in preventing mesothelioma tumors.

Determinants of Respirable Crystalline Silica Exposure Among Stoneworkers Involved in Stone Restoration Work

Objectives: Crystalline silica occurs as a significant component of many traditional materials used in restoration stonework, and stoneworkers who work with these materials are potentially exposed to stone dust containing respirable crystalline silica (RCS). Exposure to RCS can result in the development of a range of adverse health effects, including silicosis and lung cancer. An understanding of the determinants of RCS exposure is important for selecting appropriate exposure controls and in preventing occupational diseases. The objectives of this study were to quantify the RCS exposure of stoneworkers involved in the restoration and maintenance of heritage properties and to identify the main determinants of RCS exposure among this occupational group.

Methods: An exposure assessment was carried out over a 3-year period amongst a group of stonemasons and stone cutters involved in the restoration and maintenance of heritage buildings in Ireland. Personal air samples (n = 103) with corresponding contextual information were collected. Exposure data were analysed using mixed-effects modelling to investigate determinants of RCS exposure and their contribution to the individual’s mean exposure. Between-depot, between-worker, and within-worker variance components were also investigated.

Probability of Cancer in Pulmonary Nodules Detected on First Screening CT

Major issues in the implementation of screening for lung cancer by means of low-dose computed tomography (CT) are the definition of a positive result and the management of lung nodules detected on the scans. We conducted a population-based prospective study to determine factors predicting the probability that lung nodules detected on the first screening low-dose CT scans are malignant or will be found to be malignant on follow-up.

Methods

We analyzed data from two cohorts of participants undergoing low-dose CT screening. The development data set included participants in the Pan-Canadian Early Detection of Lung Cancer Study (PanCan). The validation data set included participants involved in chemoprevention trials at the British Columbia Cancer Agency (BCCA), sponsored by the U.S. National Cancer Institute. The final outcomes of all nodules of any size that were detected on baseline low-dose CT scans were tracked. Parsimonious and fuller multivariable logistic-regression models were prepared to estimate the probability of lung cancer.

Results

In the PanCan data set, 1871 persons had 7008 nodules, of which 102 were malignant, and in the BCCA data set, 1090 persons had 5021 nodules, of which 42 were malignant. Among persons with nodules, the rates of cancer in the two data sets were 5.5% and 3.7%, respectively. Garlock trial winds down; judge closes courtroom again

CHARLOTTE, N.C. (Legal Newsline) — The ongoing bankruptcy trial for Garlock Sealing Technologies wound down Monday with attorneys for the gasket manufacturing company and those representing asbestos claimants calling their last few witnesses with the judge closing the courtroom one more time during a lawyer’s testimony.

The bankruptcy trial, which began in July at the U.S. Bankruptcy Court for the Western District of North Carolina and is expected to end later this month after a week-and-a-half break, will determine the estimated liability of the company for current and future asbestos claims. One of the central questions that will help establish how much Garlock will owe the claimants revolves around whether Garlock products, many removed decades ago, and no other sources of asbestos, led to cases of mesothelioma. Judge George Hodges will ultimately decide the estimated liability of the company for current and future asbestos claims and how much money the company will need to devote to a trust to escape bankruptcy.

David Glaspy, a California lawyer who has defended Garlock on more than 25,000 asbestos claims, testified that having disclosure of exposure information claimants against the company would have helped the company significantly in their defense.

Garlock testimony switches to financial liability

Asbestos companies have for decades attempted to limit their personal injury claims liability by filing for bankruptcy protection. The Union Asbestos and Rubber Company and Johns Manville were the first in a series of companies who have sough protection. Adequately funding an asbestos personal injury claims trust is essential to protect injured workers and other victims of asbestos disease, ie. asbestosis, lung cancer & mesothelioma. As long as asbestos is not banned in the US, it is critical that these trust adequately compensate the victims and potential victims for decades into the future.

Attorneys transitioned Friday from days of expert testimony on the carcinogenic effects of asbestos and the work practices of attorneys representing asbestos plaintiffs to arguments about how much financial liability Garlock Sealing Technologies should face in the company’s ongoing bankruptcy trial.

Garlock attorneys called on economists to give the court estimates for how much money the company should place in a trust for future mesothelioma victims who might sue the company over exposure to asbestos from their products. Doing so will allow the company to escape bankruptcy.

Making The Path More Difficult for Asbestos Victims

The House Judiciary Committee has marked-up and passed legislation that will make it more difficult for asbestos victims to obtain benefits. Ironically these perennial legislative efforts make it more difficult  for those who served the US in various capacities, including military service.


The legislation, entitled, Furthering Asbestos Claim Transparency Act (FACT) of 2013, allows asbestos companies and their insurers to go on a fishing expedition, to make it more difficult to obtain even reduced benefit payments. 

The NY Times, in an Editorial, wrote, "The bill would also increase the burden on claimants to supply information. But it puts virtually no burdens on asbestos companies, like disclosing the settlements they have reached with plaintiffs or requiring them to reveal where their products were used and when, so that workers know which companies or trusts might be liable for their injuries."

Ban Asbestos: Rotterdam Conference Highjacked by "The Dirty 7"

Civil society groups attending the Rotterdam Convention conference in Geneva are expressing grave alarm that the Convention has been hijacked by the asbestos industry, which is determined to prevent the environmental and health protections of the Convention from being implemented.

For the fourth time, a handful of countries allied to the asbestos industry have refused to allow
chrysotile asbestos to be added to the Convention’s list of hazardous substances, even though the Convention’s expert scientific committee has repeatedly recommended that it be listed and even though it has been recognized that the listing of chrysotile asbestos meets all the criteria of the Convention. The committee’s conclusions are endorsed by all leading medical organisations and by the World Health Organisation.

“It is outrageous that seven countries – Russia, Kazakhstan, Kyrgyzstan, Ukraine, Zimbabwe, India and Vietnam – are turning the Rotterdam Convention into a Convention that protects profits of the asbestos industry, instead of protecting human health and the environment,” said Kathleen Ruff, co-coordinator of the Rotterdam Convention Alliance.

“The Convention requires that countries practice responsible trade by obtaining prior informed consent before they export hazardous substances to another country,” said Laurie Kazan-Allen, coordinator of IBAS, UK. “But these seven countries are determined to practice irresponsible trade and to hide the hazards of chrysotile asbestos.”

Fernanda Giannasi, a labour inspector in Brazil, reports that, in her job, she daily sees products containing chrysotile asbestos entering her country without labels, and tells of the great many victims who develop cancers from asbestos exposure in her country. “Since these countries refuse to follow responsible trade information practices, it will force other countries to resort to other measures, such as a full ban on asbestos,” said Giannasi.

“Russia and Zimbabwe recently ratified the Convention and attended the Rotterdam Convention conference of the parties for the first time,” said Sugio Furuya of the Asia Ban Asbestos Network. “It seems that they ratified the Convention with the sole purpose of wrecking it in order to protect the profits of their national asbestos industry. This is shameful, cynical conduct on their part. They are ruthlessly destroying the Convention to achieve their aim.”

“If the Convention is not going to be implemented and become empty words on paper, then what is the point of having the Convention?” asked Emmanuel Odjam-Akumatey of Ecological Restorations, Ghana. “The credibility of the Convention, and all 152 countries who have ratified the Convention is a at stake.”

“These seven countries, allied to the asbestos industry, are demonstrating contempt for the right of countries to prior informed consent, which is the whole purpose of the Convention,” said Alessandro Pugno of the Association of Asbestos Victims Families, Casale, Italy. That is why we have once against brought one hundred people, representing asbestos victims organisations, in front of the UN headquarters in Geneva and presented to the president of the conference their letter, calling for chrysotile asbestos to be listed.

US Surgeon General Alerts Americans to the Hazards of Asbestos Disease

The US Surgeon General issued an alert to Americans as to the hazards of asbestos disease, Dr. Regina Benjamin, on the occasion of National Asbestos Awareness Week 2013, has issued a statement alerting Americans to hazards of asbestos exposure.

The occupational exposure to asbestos remains a major health hazard to workers who are involved in the restoration, rehabilitation and repair of older buildings. Asbestos exposure causes latent medical conditions such as: asbestosis, lung cancer and mesothelioma, a fatal malignancy. Asbestos is still not banned in the US.


During National Asbestos Awareness Week, April 1-7, I urge Americans to learn about the dangers of asbestos exposure.

Asbestos is a mineral fiber that occurs naturally in our environment; in rock and in soil.  Because of its fiber strength and heat resistance, asbestos has traditionally been used in a variety of building construction materials, as insulation and as a fire retardant.

Activity that disturbs asbestos causes small asbestos fibers to float in the air.  Inhaling these fibers leads to asbestos-related diseases.  Three of the major health effects associated with asbestos exposure are lung cancer; mesothelioma, a rare form of cancer that is found in the thin lining of the lungs, chest, abdomen and heart;  and asbestosis, a serious progressive, long-term, non-cancer disease of the lungs.

Anyone who disturbs asbestos is at risk.  However, it is of special concern for construction, insulation, and demolition workers, pipefitters, boilermakers and others who might disturb asbestos found in old buildings or equipment as part of their work.  The hazard is also very real to home handymen, first-responders, and community volunteers.
