How foodies can become champions for workers' rights

The FCWA estimates that almost 8 million workers throughout the food system would benefit from a national minimum wage boost, and that 29 million workers over all industries would get a raise. In a Thanksgiving-themed "menu" of ways to help improve the lives of food workers, the FCWA asks foodies to sign its petition to raise the wage to $10.10, to spread the word via social media, and to write their members of Congress to urge passage of the raise.
Food workers are also mobilizing to win on three more fronts: they want nationally guaranteed paid sick days, so that they are not forced to show up to work while sick, thus contributing to the spread of infectious disease. They are demanding the right to safe workplaces: Many agricultural employers could easily provide better protections from harmful pesticides for harvest workers. Finally, the workers are demanding their right to a voice on the job, protesting against the abuse and intimidation that frequently occur in the restaurant industry when workers try to unionize.
To push for these rights, the FCWA's member groups are reaching out to consumers with messages about specific bad-actor employers in each of these areas. These employers include Wal-Mart, which has allegedly stolen wages from workers and routinely quashed unionization drives at its stores; and the Darden restaurant group, which owns Red Lobster, Olive Garden and other family-style chains. Walmart Protests Promised To Be Even Bigger This Black Friday

Walmart workers and their supporters are planning to kick off this year's holiday shopping season with protests at 1,500 Walmart stores around the country on Nov. 29. Advocates for Walmart workers hope to use Black Friday, the biggest shopping day of the year, to draw attention to what they describe as low wages and retaliation against employees who criticize the company.
Protestors are hoping for an even better turnout than last year, when hundreds of Walmart workers walked off the job in 46 states on Black Friday, according to OUR Walmart, a group advocating for Walmart workers. Protests have already occurred in multiple cities this month -- most notably in Los Angeles, where more than 50 Walmart workers and supporters were arrested in what organizers described as the largest single act of civil disobedience in the retailer’s history.
"We do expect [the protests] to be larger than last year because we have so many more members and so much more community support,” said Dan Schadelman, campaign director for Making a Change at Walmart, another advocacy group focusing on the rights of Walmart workers, in a conference call Thursday. "We're at an exciting moment, the movement of low-wage workers has taken off in 2013."
Making a Change at Walmart is seeking an end to alleged retaliation against workers, as well as to win full-time work and $25,000 per year for those who seek it.

Wages Stagnate as U.S. Manufacturers Reap Record Profits

It appears that the "great rebound" in US wages has not happened. Wages set rates of compensation benefits paid, so the lower the wages the less benefits paid. Workers' Compensation payments have become recessive and overall workers are doing worse with present workers' compensation benefit programs than in the past decades. Boeing’s quest for concessions and employees’ opposition exposed a fault line in U.S. industry’s post-recession comeback: Even with hiring and output robust enough to be dubbed a manufacturing renaissance by President Barack Obama, workers are falling behind. Factory pay hasn’t kept pace with inflation and has fallen 3 percent on that basis since May 2009, while average pay for all wage earners slid only about 1 percent.

Taxpayers pay high cost for low fast-food wages, lawmakers are told

SACRAMENTO — Low wages paid by the fast-food industry come with a high public cost for California taxpayers, academics and advocates for the working poor told state lawmakers.
Workers at hamburger, pizza and other, mainly franchise, eateries are paid at near-minimum-wage levels, making them eligible for public assistance that totaled an average of $717 million a year in California from 2007 to 2011.
The condition of low-wage fry cooks and sandwich makers was the focus of a joint hearing of the Senate and Assembly labor committees Wednesday. The inquiry was held in the wake of a 60-city protest in August by fast-food employees. Protesters, backed by the Service Employees International Union, called for collective bargaining and a $15-an-hour minimum wage.
Simone Sonnier Jang, a mother of two who works at a Los Angeles McDonald's, said she wouldn't be able to survive financially without subsidized housing, day care and medical care for her children and cash assistance.
"Without that I wouldn't be able to pay rent, cover the cost of utilities," she said, "and I wouldn't be able to buy my own food."
The drain on the safety-net funding is alarming, said Assemblyman Roger Hernandez (D-West Covina). "The taxpayer should not have to subsidize one industry," he said.
The movement got a boost in September when Gov. Jerry Brown signed legislation raising the California minimum wage from $8 to $10 an hour, in two steps, by 2016.

Dozens Hurt in Bangladesh Garment Factory Protest

Riot police fired tear gas to battle thousands of stone-throwing garment workers who rampaged through two industrial towns in Bangladesh during a protest over wages Tuesday that closed at least 200 factories and left dozens of people injured, police said.
The protesters built roadblocks with abandoned vehicles and wooden logs in violence that highlighted the poor working conditions in an industry that earns Bangladesh $20 billion in exports yearly but whose workers are the lowest paid in the world.
Thousands of angry workers hurled stones at security forces and attacked factories in the towns of Savar and Ashulia outside the capital, Dhaka, Industrial Police Director Mustafizur Rahman said. At least 200 factories closed in the second day of the protest, and 80 people were injured over two days.
Authorities deployed hundreds of paramilitary border guards to help police fighting the protesters.
"We can't accept the wages that are being offered to us. This is not enough for us," said Kahirul Mamun Mintu, a protest leader at Savar. "Our movement will continue until our demands are met."
A government-appointed panel voted last week to raise the minimum wage for garment workers to 5,300 takas ($66.25) a month — a raise by 77 percent but still the lowest minimum wage in the world. The workers are demanding 8,114 takas ($100) instead.

Exhausted Workers Recall Minimal Efforts to Enforce a Minimum Wage Law

Two weeks ago, Pin Zhu Zheng, who says she worked 69 hours a week behind a steam table at a Chinatown restaurant on Centre Street, presented herself at a New York State office to report what seemed to be flagrant lawbreaking by her former bosses.

“The first day of the month, they pay $1,500 cash,” Ms. Zheng, 55, said in an interview on Thursday. 

“Everyone got the same.”

That works out to about $5 an hour for a six-day workweek that ran from 9:30 a.m. to 9 p.m.; the law requires a minimum wage of $7.25 an hour for the first 40 hours a week. After that, workers must be paid time and a half, or a minimum of $10.88 an hour.

“The Labor Department person told me that I had to wait a year for the follow-up,” Ms. Zheng said through a translator.

But what good is a minimum wage law if it takes forever to enforce it? Complaints with the State Labor Department about wage and hour violations were stacked 14,000 high at the end of July, according to documents obtained by the Urban Justice Center through a freedom of information request.

In May 2012, the records showed, 44 percent of the cases had been open for more than a year, said David Colodny, a lawyer with the center.

Wage Statistics for 2012

The national average wage index (AWI) is based on compensation (wages, tips, and the like) subject to Federal income taxes, as reported by employers on Forms W-2. Beginning with the AWI for 1991, compensation includes contributions to deferred compensation plans, but excludes certain distributions from plans where the distributions are included in the reported compensation subject to income taxes. We call the result of including contributions, and excluding certain distributions, net compensation. The "raw" average wage, computed as net compensation divided by the number of wage earners, is $6,529,097,960,690.75 divided by 153,632,290, or $42,498.21. Based on data in the table below, about 67.1 percent of wage earners had net compensation less than or equal to the $42,498.21 raw average wage. By definition, 50 percent of wage earners had net compensation less than or equal to the median wage, which is estimated to be $27,519.10 for 2012.

Why the Left shouldn’t write off low-wage strikes.

Struggling through a frigid March rain earlier this year, rounding up carts in the parking lot of the Chicago Whole Foods where I work, one of my bosses stood at the door.
“That weather really sucks,” he said offhandedly. I nodded tersely. “But, hey,” he continued, chuckling. “What are you going to do? Go on strike?”
It made sense that he found the idea of us striking absurd – strikes are at an all-time low, nearly nonexistent in shops like mine, and almost none of my co-workers have ever been in a union. But a month later, we did. Ten Whole Foods workers walked off the job to protest a draconian attendance policy and poverty wages, along with 200 fast food and retail workers across the city and thousands across the country.
Low-wage fast food and retail workers took center stage for the American labor movement this summer. The Fight for 15 (FF15) campaign went public last November, then erupted earlier this spring, as workers walked off the job in New York, then Chicago, then St. Louis, Milwaukee, Detroit, and Seattle. Seven cities organized a second week of one-day strikes at the end of July. Then, on August 29, 62 cities and more than 1,000 workers struck around two principal demands: $15 an hour minimum wage and the right to form a union without retaliation.

Study: Workers with disabilities paid 10% less

Workers with disabilities are paid about 10% less than other workers in similar jobs, and 8% less in total compensation, including wages, health insurance and vacation time, according to a new Cornell University study.
Research by Cornell's School of Industrial and Labor Relations found that people with disabilities are more likely to opt for jobs that pay lower wages but offer strong benefit packages.
"So you might imagine someone taking a job for $40,000 with health insurance or a job for $60,000 without health insurance," Kevin Hallock, director of the Institute for Compensation Studies at Cornell, said during a presentation at a conference on disability employment Wednesday in Arlington, Va.
Workers with disabilities also are overrepresented in manual labor jobs and underrepresented in white-collar fields. The study found transportation, production, and office and administrative support were among the top occupations where people with disabilities were employed.
Skilled jobs, including management, business and finance occupations, employed the lowest number of people with disabilities.
The Cornell research has some limitations: Only full-time male workers were surveyed to determine wage gaps because researchers wanted to isolate a similar group of individuals without introducing other variables such as gender.

Voters Will Decide on Minimum Wage Hike - Impacting Workers Compensation Benefits

The state’s current minimum wage is $7.25 an hour. If you work a 40-hour week, that’s $290 a week, or $1160 a month, before taxes, in a region where the average monthly rent is $1,760. Take away food, transportation and other incidental costs and, well, you do the math. It’s why a broad coalition of labor, elected and other officials are pushing hard for Public Question 2, 

which would change the state’s constitution to raise the minimum wage to $8.25, and tie future increases to the cost of living, something that newspaper vendor Tony White would welcome.
“It would be nice if was $8.25 for a lot of jobs out here because the minimum wage has been down for a long time. It’s time for the little people to make a little something, ya know? That’s all,” White, of Newark, said.

Tazia Treadwell knows about working for $7.25. She did it for a couple of years at a fast food restaurant just out of high school.

“After two, three months, I got a 10-cent raise, so I was at $7.35 an hour. After two years, no progress. I was was frustrated. I was just out of high school and I was at that stage where I wanted everything new, the latest of everything and I could barely do that,” Treadwell said.

McDonald's Profit Is Awkwardly Close To What It Costs Taxpayers Every Year

McDonald's announced Monday that it raked in $1.5 billion in profits in the third quarter, up 5 percent from last year.
The number is strikingly close to the $1.2 billion taxpayers are shelling out each year to help pay public assistance to the McDonald's workforce, according to a report released last week by the National Employment Law Project.
chartThe echoing numbers are simply a coincidence, but underscore the immense profits that the chain continues to pull in while its workers simply struggle to afford food, medical help and housing. The public assistance McDonald's workers receive comes via food stamps, welfare, Medicaid and other federal programs, according to the NELP report.
In a statement to The Huffington Post, McDonald's emphasized that workers get training and the opportunity for career advancement. The company also said that its franchisees pay competitive wages that are based on "local wage laws."
Those wages are stunningly low. Frontline fast-food workers make a median wage of $8.94 an hour, according to a recent Reuters report. "Fast-food workers work only 24 hours a week on average — at $8.94 an hour, this adds up to barely $11,000 a year," wrote Christine Owens for Reuters in August.
With wages that low, front-line fast food workers are more than twice as likely as the typical worker to participate in a government assistance program, according to the NELP report:

In Washington State, Home of Highest Minimum Wage, a City Aims Higher

Washington already has the highest state minimum wage in the country, at $9.19 an hour. Soon, voters in this tiny city south of Seattle will decide whether to push the local minimum even higher.
If a majority of the voters here say yes to a referendum known as Proposition 1 when their mail-in ballots start arriving this week, a minimum wage of $15 an hour would be required for many businesses in SeaTac, more than twice the federal minimum of $7.25.

The measure would lift wages for thousands of workers at one of the nation’s busiest airports, Seattle-Tacoma International, which is within city limits. But business and labor leaders say the economic and political implications, with local democracy going where state and federal legislators mostly fear to tread, could be equally profound.

President Obama has also shown sympathy for the issues of low-wage workers, although the minimum wage increase he's expressly supported -- to $9 an hour -- is still less than what activists usually consider a "living wage."
"I think the president's heart in the right place," Ellison said. "We’ve just got to get his pen on the right place."
Federal contractors employ over a fifth of the American civilian workforce, and more than 560,000 of these workers earn $12 or less an hour, according to Demos, a liberal think tank. Many of them are cleaners and concession workers in federal buildings. If you include all the low-wage jobs funded by public dollars, including the 1.2 million paychecks underwritten by Medicare and Medicaid, the total, Demos found, surpasses the low-wage workforce of Walmart and McDonald’s combined.
Labor group Good Jobs Nation, backed by the Service Employees International Union, organized three smaller building-specific strikes earlier this year, as well as a city-wide labor action in May. It’s part of a larger strategy by unions and labor activists to push for higher wages in the largely non-unionized workforces of retail and fast food. Organizers called Wednesday's event the largest low-wage federal worker strike to date. Both Ellison and Sen. Bernie Sanders (I-Vt.) gave passionate speeches at the event.

The High Price of Gas – Mileage Reimbursement for Injured Workers

     Injured workers who are are dependent on time loss compensation payments of only 60-75% of their wages unfortunately are well used to the enormous financial losses and constraints this wage loss puts on their family budgets.  With budget cuts being made by the Department of Labor & Industries which place additional burdens on workers by reducing reimbursements for the additional costs incurred as a result of an injury, it is important to be aware of what you can be reimbursed for, and what some relatively new regulations do not cover.  The current mileage reimbursement rate is now 56.5 cents per mile.
When money is tight, making sure you receive everything you are entitled to under your claim is important!
     Injured workers are always entitled to receive travel and/or wage reimbursement if they are asked to attend an IME (Independent Medical Exam).  However, we have noted that more recently both the Department and self-insured employers are failing to provide workers with the form necessary to be reimbursed gas mileage for what are often not insignificant distances.   Many workers are unaware they can have their wages reimbursed as well if they miss time from work.  The form can be found online here.  When self-insured employers do not provide our clients with a reimbursement form when sending out IME notices, we will send out the Department’s standard form.
     More difficult to decipher are the rules allowing for travel reimbursement for medical treatment or vocational services.  A different form must be filed to obtain reimbursement for these expenses.  At Causey Law Firm, we insure that our clients are reimbursed for travel for vocational meetings which take place in our office.  Parking is expensive in Seattle, and that cost can be reimbursed to you directly.  Some law firms charge a fee on travel reimbursement expenses, but we do not.
     While injured workers have the right to treat with their own preferred provider, travel reimbursement is only paid for regular treatment visits if there is no adequate treatment provider within 15 miles of their home AND if the claims manager has pre-authorized the travel.  Travel reimbursement is now limited for regular medical treatment visits by the so-called “15 mile rule”.  Thus, if your pre-authorized provider is 30 miles from your home, reimbursement will only be provided for the last 15 miles each way of that trip.  As with medical appointments, regular visits to meet with a vocational counselor are only covered after that 15 mile threshold has been reached.  If you are approved for a formal vocational retraining plan, however, mileage may be fully reimbursable through your plan with necessary signatures and paperwork submitted through a vocational rehabilitation counselor.
      Many workers are unaware of their right to apply for reimbursements, which can be submitted to the Department for a period up to one year of the date of travel.  The Department’s general guidelines can be seenhere.  When money is tight, making sure you receive everything you are entitled to under your claim is important!

Many States Look to Raise Minimum Wage

California’s recent decision to raise its minimum wage to $10 an hour by 2016—a higher minimum rate than any other state has now—may add momentum to the drive for higher hourly rates in at least eight other states in 2014.

New Jersey could become the fifth state this year to increase its state minimum wage if voters approve a measure on Nov. 5 that would boost the hourly rate by $1, to $8.25.

In states as varied as Alaska, Idaho, Massachusetts and South Dakota, advocates are pushing to put minimum wage hikes on state ballots in 2014. Meanwhile, elected officials are leading the charge in Hawaii, Illinois, Maryland, Minnesota, and the District of Columbia.

The action at the state level comes as organized labor and liberal groups have backed a wave of strikes by fast-food workers in cities across the country to put a spotlight on hourly wages.  Advocates are pressing for a national $15 hourly wage, more than twice the $7.25 federal minimum wage.

States cannot set a minimum wage that is lower than the federal standard, but they are free to establish a higher one. Washington state currently has the highest state minimum wage at $9.19; followed by Oregon ($8.95) and Vermont ($8.60). Connecticut, the District of Columbia and Illinois all have a state minimum of $8.25. In addition, some 120 cities have enacted “living wages” that set a minimum standard for businesses that receive city contracts. City minimums range from $9 to $16 an hour.

Tips and Poverty

When The Times’s restaurant critic, Pete Wells, recently called tipping “irrational, outdated, ineffective, confusing, prone to abuse and sometimes discriminatory,” he was referring mainly to mid- to high-priced restaurants that are considering an end to the practice in favor of surcharges or service-included pricing.

In the diners and other more “value oriented” restaurants that employ most of the nation’s burgeoning ranks of waitresses (the vast majority of servers are female), tips are all that and more. They are part of a parallel economic universe in which employers are allowed to pay sub-minimum wages, with predictably devastating results. According to census data, servers are far more likely than other workers to live in poverty.

It is a national disgrace when hard work, in any industry, leaves workers in poverty. But falling living standards and economic hardship among tipped workers signal prolonged stagnation throughout the economy. That’s because employment growth in restaurants and bars has outpaced growth in nearly all other sectors in recent years, including health care, manufacturing, retail and financial services. 

If wages in food-service and other service jobs are not lifted, it is hard to see where adequate consumer demand will come from to generate and sustain a real recovery.

It is not tipping that most needs to end, however. What needs to change is the federal law that sets the minimum wage for tipped workers...
